The Republic of Moldova is obliged, according to the signed international treaties, to create effective mechanisms for the prevention and eradication of torture, inhuman and\/or degrading treatment, as well as to provide victims with effective rehabilitation remedies. Still, Moldova is often convicted at the European Court of Human Rights (ECtHR)<\/span> for violating art. 3 of the European Convention on Human Rights (ECHR) that prohibits torture, and inhuman or degrading treatment or punishment, Amnesty International<\/strong> (AI) said<\/a>.<\/p>\n

107 convictions finding 149 violations<\/strong> of art. 3 were issued by ECtHR until June 1, 2021. “Most of these violations relate to the application of ill-treatment and their incorrect investigation by state representatives (67), but also to poor detention conditions (46).”<\/em> AI reports that the documentation of torture and other inhuman and\/or degrading treatment is not always carried out effectively by the responsible state institutions<\/span>, “which makes it difficult to investigate cases and prosecute the guilty.”<\/em><\/p>\n

Another issue is the lack of respect for the rights of detainees in Moldovan penitentiary institutions. Fundamentals rights of detainees are not respected in the Moldovan prisons<\/span>. “In some cases, no effective measures are taken to ensure the right to independent healthcare, including diagnostic investigations in public medical institutions, which are also necessary for the correct prescription of the necessary treatment.”<\/em> The penitentiary institutions staff often claim that the impossibility of transporting detainees would be the reason, as this would mean costs with the involvement of additional services, staff and specialized means of transport.<\/p>\n

A lot of prisons from the Republic of Moldova are in a degrading state, the cells and the detention spaces needing serious reparations. Therefore, beside the ill treatment, poor detention conditions can also be considered circumstances of torture and\/or degrading treatment. “Moldovan penitentiaries are in a disastrous and overcrowded state, including due to the excessive application of pre-trial detention. The authorities of the Republic of Moldova have been warned several times that they do not apply alternative forms of prevention, in case of poor detention conditions. The quality of food is mainly determined by the allocation of insufficient resources to feed detainees.”<\/em><\/p>\n

Moreover, the penitentiary system does not fight effectively with the informal hierarchy and criminal penitentiary subculture that leads to violence and intimidation among convicts, is stated in the AI communication<\/a>. “The criminal hierarchy and violence between prisoners are tolerated.”<\/em><\/p>\n

“Recently, the United Kingdom refused to extradite Moldovan citizens due to poor detention conditions and violence between detainees. British courts have found that the Moldovan authorities have not kept their promises to place extradited people in decent detention conditions and without the risk of them being subjected to violence in the penitentiary system.”<\/p><\/blockquote>\n

Police officers and state officials involved in torture and other inhuman and\/or degrading treatment have always enjoyed impunity in Moldova. According to the AI, “such shortcomings have caused a deep sense of injustice among victims of terror and police abuse. Over time, many of the victims have lost hope of obtaining justice in Moldova. Some sought justice at the European Court of Human Rights (ECtHR), and others decided to leave the Republic of Moldova for good.”<\/em><\/p>\n

“It is unfortunate that in the context of the events of April 2009, no police officer served a custodial sentence. It is serious that some of those against whom criminal cases were filed and later closed, were able to return and continue to work in the police, being also promoted.”<\/p><\/blockquote>\n

Thus, the representatives of Amnesty International called<\/a> on the Moldovan authorities to support the implementation of a proposed set of the measures, especially the National Action Plan in the field of Human Rights 2018\u20132022<\/strong>, in order to prevent further inhuman or degrading treatment, and support victims of torture. “It is undeniable that torture and inhuman treatment cause immeasurable damage not only to the victim, but also to those around him – family, friends, society. Finally, torture seriously affects any community and society, seriously tarnishing the image, legitimacy of state power and the credibility of state institutions.”<\/em><\/p>\n
