A few hours ago, President Maia Sandu<\/strong> signed the decree of dissolving the current legislature and announced the date of snap parliamentary elections: July 11, 2021<\/strong>. “With this decision, we opened the way for the citizens to be able to elect a new Parliament, which will serve the interests of the country and the people. Power is now in the hands of the people,”<\/em> said<\/a> Maia Sandu.<\/p>\n

The presidential decree was signed after the Constitutional Court<\/strong> (CC) decided, also today, that the previously declared state of emergency was unconstitutional.<\/span> Removing the existing state of emergency was an important precondition for enabling Parliament’s dissolution and holding snap elections.<\/p>\n

According to the CC judgement<\/a>, no arguments were provided to justify the duration of the state of emergency (two months). Furthermore, Parliament did not explain the extent to which the ordinary duties of the executive were insufficient to overcome the crisis situation, especially in the context of Parliament’s dissolution that was about to be discussed after the president announced that a request was filed to CC in this regard.<\/p>\n

“The most important consequence of establishing a state of emergency is the impossibility of dissolving Parliament – a goal that does not pursue the public interest in fighting COVID-19. Some measures that were imposed, such as restricting freedom of movement between 11 p.m. and 5 a.m. or banning access to public spaces, were lifted shortly after that, indicating their inconsistency and uselessness,”<\/em> it is mentioned in an informative note<\/a> of Promo-LEX Association<\/strong>.<\/p>\n

President of Constitutional Court, Domnica Manole<\/strong>, also noted in a press conference<\/a> that the CC judges and, in particular the president of the institution, were subjects to Parliament’s offensive attacks. First, the majority government declared a state of emergency in the Republic of Moldova from April 1 to May 30. 52 Members of Parliament (MPs) adopted a decision in this regard at the end of March, without a clear plan of restriction measures or actions to support affected people and businesses. That is while the Constitution<\/a> of the Republic of Moldova states that Parliament cannot be dissolved during a state of emergency, siege or war. It was clear, at that moment, that it was not more than a political decision, as MPs feared of loosing their seats in the legislature.<\/p>\n

Nonetheless, the Constitutional Court ascertained, on April 15, that the conditions justifying the dissolution of the Parliament were met<\/span>, scheduling another hearing regarding the constitutionality of establishing the state of emergency. Thus, Parliament’s majority government resorted to desperate measures – they \u00a0adopted a declaration on the recognition of the Constitutional Court captivity, withdrew their vote of confidence for Domnica Manole as judge of CC and appointed a new magistrate right away.<\/p>\n

Yesterday, Parliament’s decisions regarding the cancellation of the CC president term of office and appointment of another judge were declared unconstitutional<\/span> by the Court. “There is no possibility of displacing the Constitutional Court judges by the authorities that appointed them, the judges being irremovable, which is a guarantee of their independence. This principle protects judges primarily from external influences in the performance of their judicial duties. The fundamental idea is that constitutional judges are not employees of the authorities that appointed them,”<\/em> is explained in the CC decision<\/a>.<\/p>\n

What’s more, the appointed by the majority government judge requested the annulment of the decision. “Reaffirming the goal of bringing peace to the society, which is antagonized by the populist statements of some politicians, but also refusing to accept the further damage to the image of the High Court, I request the annulment of my appointment,”<\/em> Boris Lupascu<\/strong> stated in his request<\/a>.<\/p>\n

“After elections, a responsible Government will be appointed, based on a stable majority. We will get out of the crisis, we will put things in order and all state institutions will work for the good of the people. […] A great effort follows. The citizens have won the right to claim their future. Now, the responsibility of this future lies on the shoulders of each of us,”<\/em> concluded<\/a> President Maia Sandu today.<\/p>\n
