This time, the parliamentary majority government adopted a declaration on the <em>&#8220;recognition of the Constitutional Court captivity&#8221;<\/em> during yesterday&#8217;s <a href=\"https:\/\/www.privesc.eu\/arhiva\/94557\/Sedinta-Parlamentului-Republicii-Moldova-din-23-aprilie-2021\">plenary session<\/a>. The statement, which in fact has no legal effect, claimed that the institution would be captured and that the judges who issued the decision regarding Parliament\u2019s dissolution admitted the violation of procedure and constitutional law. What&#8217;s more, 56 Members of Parliament (MPs) voted to <span style=\"color: #993300;\">withdraw their own decision (from 2019) on the appointment of Domnica Manole as judge of the Constitutional Court (CC), while appointing a new magistrate<\/span> in her place (Boris Lupascu), who was immediately invited to take the oath, all that in just one session.<\/p>\n<p>The judges of the Constitutional Court consider that the statement on the recognition of the CC captivity has an exclusively political nature<em>. &#8220;According to article 121 of Parliament&#8217;s Procedure, such acts produce only political effects,&#8221;<\/em> is stated in a <a href=\"https:\/\/www.constcourt.md\/libview.php?l=ro&amp;idc=7&amp;id=2159&amp;t=\/Media\/Noutati\/Cu-privire-la-hotararea-Parlamentului-care-vizeaza-Curtea-Constitutionala\">press release<\/a> issued by CC representatives. The judges emphasised the fact that such actions<em> &#8220;harm the rule of law, the image of the Constitutional Court and jeopardize the implementation of a true culture of constitutionalism in the Republic of Moldova.&#8221;<\/em><\/p>\n<h3>President and opposition<\/h3>\n<p>Opposition MPs described the actions in Parliament as an attack on CC and called on citizens to defend the institution. People gathered yesterday in front of the CC building to defend justice.<\/p>\n<p><iframe style=\"border: none; overflow: hidden;\" src=\"https:\/\/www.facebook.com\/plugins\/video.php?href=https%3A%2F%2Fwww.facebook.com%2Fpartidulpas%2Fvideos%2F187782639724730%2F&amp;show_text=0&amp;width=560\" width=\"560\" height=\"315\" frameborder=\"0\" scrolling=\"no\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/p>\n<p>President Maia Sandu <a href=\"https:\/\/www.youtube.com\/watch?v=f3ioOVQ8qTU\">characterised<\/a> Parliament&#8217;s decisions as illegal and unconstitutional, <span style=\"color: #993300;\">asking the Office of the Prosecutor General to investigate them as potential abuse of power.<\/span> The <strong>Moldovan National Platform of the Eastern Partnership Civic Society Forum<\/strong> &#8211; a platform including 95 national and international member organisations &#8211; published a <a href=\"https:\/\/www.eap-csf.md\/en\/public-appeal-of-the-national-platform-of-the-eastern-partnership-civil-society-forum-on-the-attempt-of-abuse-of-state-power-by-a-group-of-mps-in-the-parliament-of-the-republic-of-moldova\/\">\u00a0statement<\/a>, urging the Parliament of the Republic of Moldova and other politicians to refrain from attacks on the Constitutional Court and its judges. <em>&#8220;We find that the actions taken by the majority government regarding withdrawing the vote of confidence for Domnica Manole are contrary to the Constitution, the Law on the Constitutional Court, the Constitutional Court Decision no. 8\/2013 and comprise elements of the abuse of state power.[&#8230;] We support the decision of the President of the Republic of Moldova to convene the Supreme Security Council in order to discuss and take immediate action by the competent authorities that are required to stop illegal actions against the Constitution and state power.&#8221;<\/em><\/p>\n<h3>International officials<\/h3>\n<p>Representatives of several European institutions and diplomatic missions expressed their concerns regarding the legislature&#8217;s actions. There is no such thing as a \u201cno-confidence vote in the judges of the Constitutional Court\u201d under the Constitution of the Republic of Moldova.[&#8230;] This no-confidence vote is in clear contradiction not only with Article 137 of the Constitution of Moldova, but also with European Standards on constitutional justice.[&#8230;] Parliament has declared the existence of a situation of severe constitutional and political crisis. <span style=\"color: #993300;\">I reiterate that unconstitutional actions against another state institution are not conducive to solving any crisis.<\/span> Democratic culture and maturity require institutional restraint, good faith and mutual respect between State institutions. I condemn these political practices, which are in disagreement with the interests of the Republic of Moldova and with the European path that this country has taken in recent years,&#8221;<\/em> <a href=\"https:\/\/www.facebook.com\/IoanDragosTudorache\">declared<\/a> the European Parliament\u2019s rapporteur on Moldova, <strong>Drago\u0219 Tudorache.<\/strong><\/p>\n<p><em>&#8220;While the vote of the majority of Parliament to condemn the Constitutional Court is non-binding, this lack of respect for the separation of powers is a troubling sign for Moldova\u2019s future,&#8221;<\/em> is stated in a <a href=\"https:\/\/www.facebook.com\/U.S.EmbassyMoldova\">declaration<\/a> of the <strong>U.S. Embassy in Moldova.<\/strong><\/p>\n<h3>Experts<\/h3>\n<p>The former president of CC, <strong>Alexandru Tanase<\/strong>, <a href=\"https:\/\/www.facebook.com\/sandu.tanase\">claimed<\/a> that<span style=\"color: #993300;\"> the decision on withdrawing the vote of confidence for Domnica Manole does not produce any legal effect and may not terminate the judge&#8217;s term of office<\/span>. Moreover, the declaration on the recognition of the CC captivity is <em>&#8220;a political statement that reflects the views of those who voted for it and should be treated as such.&#8221;<\/em> Alexandru Tanase explained that the legal provisions don&#8217;t allow interruption of CC judges&#8217; terms of office, as this represents<em> &#8220;an impermissible interference in the activity of the Constitutional Court. Such an intervention is a violation of the principle of CC independence.&#8221;<\/em> Therefore, Parliament&#8217;s decisions are considered unconstitutional.<\/p>\n<blockquote><p>&#8220;Neither the Constitution, nor the Law on CC provides for a procedure of revising the vote for the appointment of a constitutional judge. Such a procedure cannot even be envisaged. If there was a possibility of returning, after a period, to the votes cast for the adoption of decisions appointing constitutional judges, based on current political or personal interests, the independence of CC, the state legislative authority, and the security of legal relations would be compromised.&#8221;<\/p><\/blockquote>\n<p>Other constitutional experts also believe that socialist MPs (who proposed the bills) are not aware of the text and the meaning of the Constitution. The constitutional expert, Alexandru Arseni, <a href=\"https:\/\/www.zdg.md\/stiri\/stiri-sociale\/socialistii-au-cerut-demisia-a-trei-membri-cc-ce-spune-legea-cum-nupot-fi-demisi-judecatorii-curtii-constitutionale\/\">confirmed<\/a> that the judges of the Constitutional Court cannot be dismissed or relocated to another high state position.<\/p>\n<h3>Suspending a suspending decision<\/h3>\n<p>The MP and the member of the Party of Action and Solidarity (PAS), <strong>Sergiu Litvinenco<\/strong>, announced that a complaint was filed to CC in connection with the bills voted by Parliament the same day. If there was a possibility of returning, after a period, to the votes cast for the adoption of decisions appointing constitutional judges, based on current political or personal interests, the independence of CC, the state legislative authority, and the security of legal relations would be compromised.&#8221;<\/p><\/blockquote>\n<p>Other constitutional experts also believe that socialist MPs (who proposed the bills) are not aware of the text and the meaning of the Constitution. The constitutional expert, Alexandru Arseni, <a href=\"https:\/\/www.zdg.md\/stiri\/stiri-sociale\/socialistii-au-cerut-demisia-a-trei-membri-cc-ce-spune-legea-cum-nupot-fi-demisi-judecatorii-curtii-constitutionale\/\">confirmed<\/a> that the judges of the Constitutional Court cannot be dismissed or relocated to another high state position.<\/p>\n<h3>Suspending a suspending decision<\/h3>\n<p>The MP and the member of the Party of Action and Solidarity (PAS), <strong>Sergiu Litvinenco<\/strong>, announced that a complaint was filed to CC in connection with the bills voted by Parliament the same day.
