At the beginning of this month, Speaker of Parliament, Zinaida Greceanii<\/strong>, sent a letter<\/a> to Secretary General of the Council of Europe (CoE), Marija Pej\u010dinovi\u0107 Buri\u0107<\/strong>, criticising the request submitted by President Maia Sandu to the Constitutional Court (CC), asking the institution to ascertain the constitutional circumstances for the dissolution of Parliament. The Moldovan official stated in the letter that “the actions of the President of the Republic of Moldova are an attempt to violate her constitutional obligations and her neutral power, creating institutional blockages with unpredictable consequences for democracy and the rule of law.” <\/em>Moreover, Greceanii asked the Constitutional Court to challenge the amicus curiae opinion of the European Commission for Democracy through Law of the Council of Europe regarding the request for finding the circumstances that justify the dissolution of the Parliament.<\/p>\n

The actions of the head of state were qualified as irresponsible “under the conditions of an unprecedented pandemic crisis and while there is a political will to vote a Government.” <\/em>Speaker of Parliament asked for the mediation of Moldova’s institutional conflict (President and Parliament), in order “to redirect the country’s president in the constitutional field”<\/em>, as Greceanii mentioned in the letter sent to CoE.<\/p>\n

Today, Parliament’s press service announced<\/a> that Speaker of Parliament received a reply from Secretary General of the Council of Europe and will forward it to CC. The answer signed by Secretary General of CoE stated that “the rules for the formation of the Government and the dissolution of the Parliament are stipulated in the Constitution and interpreted by the Constitutional Court<\/span>. In the Republic of Moldova, they were also the subject of an opinion of the Venice Commission (CDL-AD (2019) 012). The opinion emphasized that the dissolution of a parliament elected by free and fair elections is a measure of last resort that cannot be taken easily but only following the the Constitution.”<\/em><\/p>\n

At the same time, the CoE official emphasised the importance of institutions’ cooperation, so that their constitutional obligations would be fulfilled. “This leads me to call on the sense of responsibility of all institutions and all stakeholders in the Republic of Moldova to avoid a constitutional crisis, especially in the current period marked by the health crisis affecting all our Member States.”<\/em><\/p>\n

“Still, if the Republic of Moldova considers that these constitutional issues are likely to reappear in the future, the Council of Europe is willing to explore possible constitutional changes, which may be necessary or desirable in order to provide lasting answers in this regard.”<\/p><\/blockquote>\n

The CoE message instantly started to be interpreted by Moldovan politicians. The socialists’ leader Igor Dodon<\/strong> declared that the Council of Europe confirmed that Parliament cannot be dissolved if there is a majority ready to vote for a Government<\/span>, while that wasn’t explicitly mentioned in the document. “On April 15 [the day when CC will decide on President’s request], the Constitutional Court will have to demonstrate impeccable legal skills, so as to satisfy Western ambassadors and enable President Maia Sandu to dissolve Parliament, contrary to constitutional rules and European principles of the rule of law,”<\/em> Dodon said<\/a>. According to him, if that happens, the institution doesn’t deserve to be trusted anymore.<\/p>\n

Opposition Members of Parliament (MPs) believe that socialists (including Speaker of Parliament Zinaida Greceanii) are trying to manipulate public opinion and put pressure on the judges of CC. That is while the decision on ascertaining the legal circumstances for the dissolution of Parliament is to be taken by the Constitutional Court only. “Both the letter and the spirit of the Constitution, including the jurisprudence of the Constitutional Court were respected, as basically all constitutional experts from the Republic of Moldova explained and as Mrs. Buri\u0107 stated, along with other partners of our country,”<\/em> claimed<\/a> the MP Mihai Popsoi<\/strong>.<\/p>\n

President of the Republic of Moldova, Maia Sandu, submitted a request to CC regarding the ascertainment of the constitutional circumstances for the dissolution of Parliament. As the president stated<\/a>, Parliament failed to elect a Government after two attempts, and after 45 days from the first request for voting, as well as more than 3 months passed since the resignation of the Chicu Government. “Along with experts in constitutional law, I believe that the legal circumstances for the dissolution of Parliament are met. […] If the Constitutional Court decides that, I will dissolve the Parliament and we will go to people’s court [elections].”<\/em><\/p>\n
