Several human rights organizations and a lawyer from Moldova signed a common declaration<\/a> concerning April 7, 2009 – the day when “more than 600 people were ill-treated, arrested and cruelly beaten, did not receive independent and fair justice, were detained in humiliating conditions, without water and food,”<\/em> as it is mentioned in the declaration. That day and the following ones, at least 5 people died in suspicious circumstances<\/span>, despite the fact that state authorities claimed only one death, the organisations’ representatives added.<\/p>\n

On April 5, 2009, the results of parliamentary elections were announced, showing another victory of the Party of Communists of the Republic of Moldova. They won the absolute majority of Parliament’s seats. On April 7, thousands of young people protested in the Grand National Assembly Square against the communist regime. Later on, the protests degenerated into confrontations with the police and destruction of state buildings.<\/span><\/p>\n

Amnesty International Moldova, Promo-LEX Association, “Memoria” (tr. as memory) Center for Victims of Torture Rehabilitation, Moldova’s Legal Resources Center, Human Rights Embassy, Council for the Prevention of Torture and lawyer Ion Guzun<\/strong> believe that the criminal investigation related to April 7 events failed, as all responsible officials and policemen who tortured protesters have been acquitted or their case was removed from prosecution.<\/p>\n

As a consequence of those events, 71 criminal cases were filed (out of which 42 for torture and 19 for committing abuse of official duties), the Office of Prosecutor General informed<\/a>.<\/p>\n

12 years later, no one is serving a prison sentence for the committed abuses (and has never did so). There is only one fugitive police officer who was sentenced to prison and only one criminal case involving a deputy commissar still being examined. Moreover, it seems that the latter no longer risks getting behind bars, as the limitation period for the offenses for which he could be convicted has expired. <\/span>“Neither the judges who handed down sentences to convict young people, nor the police officers who beat people, nor the bosses who gave instructions and then covered and protected the culprits did not suffer any consequences,”<\/em> President Maia Sandu stated<\/a> today.<\/p>\n

The European Court of Human Rights (ECtHR) has condemned Moldova in 8 cases. The Republic of Moldova has paid almost 5 million lei, for the inaction of law enforcement bodies following the events of April 7-8, 2009. Other 40 requests are still being examined at ECtHR, the NGOs’ representatives announced.<\/p>\n

Their statement emphasized that not only the responsible officials were not punished, but also they continue to hold management positions in state institutions. “We consider that the criminal investigation bodies and the\u00a0Office of Prosecutor General did not make the necessary efforts to bring those responsible to justice, and as a result the courts did not convict them for various reasons.”<\/em> They blamed the authorities for inaction and ignorance towards the citizens and international organisations. “The multiple recommendations addressed to the Government of the Republic of Moldova by the specialized agencies of the United Nations, the Council of Europe, the OSCE were basically ignored.”<\/em><\/p>\n

“We regret that hundreds of torture victims and their relatives have been traumatized for life. They have not received any real support from state authorities, except for monetary compensation, which is extremely small compared to the damage caused.”<\/p><\/blockquote>\n

The relatives of killed young people claim<\/a> that state authorities are not only indifferent to what happened, but also they try to defend politicians involved in those events.<\/span> “Those who continue to break the law and work against their own people can only do so because they have protection – in the Office of Prosecutor General, in courts, in Parliament,”<\/em> the president of the country said<\/a>, “but we can break their circle of protection – they are few and rely on each other. Most people in our country are honest citizens, who pay taxes and earn an honest living.”<\/em><\/p>\n
