The CC <a href=\"https:\/\/www.privesc.eu\/arhiva\/93781\/Sedinta-Curtii-Constitutionale-privind-controlul-constitutionalitatii-Decretului-Presedintelui-Republicii-Moldova-nr--32-IX-din-11-februarie-2021-priv\">decided<\/a> that the presidential decree was <strong><span style=\"color: #993300;\">unconstitutional<\/span><\/strong>, announcing that President Maia Sandu was obliged<strong> to hold new consultations with the parliamentary groups in order to nominate a candidate for the position of prime minister.<\/strong><\/p>\n<p>2 weeks ago, the appointed candidate for the position of prime minister, Natalia Gavrilita, was still presenting her team and a Government program at Parliament\u2019s <a href=\"https:\/\/www.privesc.eu\/arhiva\/93718\/Sedinta-Parlamentului-Republicii-Moldova-din-11-februarie-2021\">plenary session<\/a>, when the socialists submitted their own candidate and declared that a majority government of 54 MPs was going to be formalised, so that the socialist candidacy could be submitted to President Maia Sandu.<\/p>\n<p>Gavrilita&#8217;s Government was given the no confidence vote. The majority government formed of socialist MPs, the Sor Political Party members and some ex-democratic turncoats, called the Platform &#8220;For Moldova&#8221;, <a href=\"https:\/\/www.privesc.eu\/arhiva\/93726\/Declaratiile-lui-Pavel-Filip-in-timpul-sedintei-Parlamentului-Republicii-Moldova-din-11-februarie-2021\">announced<\/a> their support for a new candidate &#8211; <strong>Mariana Durlesteanu. <\/strong>That happened despite the fact that, previously, all parliamentary groups agreed that any cabinet of ministers submitted to the current Parliament wouldn\u2019t be voted, as this was the shortest way to trigger snap parliamentary elections<em>.<\/em><\/p>\n<p>Instead of appointing the socialist candidate, President Maia Sandu<span style=\"color: #993300;\"><span style=\"color: #000000;\"> <a style=\"color: #000000;\" href=\"https:\/\/www.presedinte.md\/rom\/presa\/presedintele-maia-sandu-o-inainteaza-repetat-pe-natalia-gavrilita-la-functia-de-prim-ministru-al-republicii-moldova\">announced,<\/a> on February 11,<\/span> <span style=\"color: #000000;\">that the candidacy of Natalia Gavrilita was submitted for the second time<\/span><\/span><span style=\"color: #000000;\">. <\/span>The president informed that the letter proposing Mariana Durlesteanu, signed by 54 MPs, includes signatures that, as the president claimed, <span style=\"color: #993300;\">were obtained through corruption and external pressure.<\/span><\/p>\n<p><span style=\"color: #000080;\"><strong>See also:<\/strong> <a style=\"color: #000080;\" href=\"https:\/\/www.moldova.org\/en\/playing-games-in-parliament-the-winners-the-losers-and-the-cost-of-having-a-government\/\">Playing games in Parliament: The winners, the losers and the cost of having a Government<\/a><\/span><\/p>\n<p>During the CC <a href=\"https:\/\/www.privesc.eu\/arhiva\/93781\/Sedinta-Curtii-Constitutionale-privind-controlul-constitutionalitatii-Decretului-Presedintelui-Republicii-Moldova-nr--32-IX-din-11-februarie-2021-priv\">sitting<\/a> contrary positions were heard.<em> &#8220;We consider that President Maia Sandu ignored the decisions of the CC and the Constitution by signing this decree.[&#8230;] This decree sought to subordinate Parliament,&#8221;<\/em> declared the socialist MP, Vasile Bolea.<\/p>\n<p><em>&#8220;There is no majority government to submit a candidacy for the position of prime minister,&#8221; <\/em>said Olesea Stamate, the Presidency representative. <em>&#8220;To allow a conjuncture majority government, formed of people with serious integrity problems, to nominate [&#8230;] the candidate for prime minister would mean an enormous risk of recapturing the executive by oligarchic groups, contrary to the sovereign decision of Moldova&#8217;s people,&#8221;<\/em> Olesea Stamate also claimed.<\/p>\n<h3>The CC explanation<\/h3>\n<p><a href=\"https:\/\/www.constcourt.md\/libview.php?l=ro&amp;idc=7&amp;id=2097&amp;t=\/Media\/Noutati\/Decretul-Preedintelui-Republicii-Moldova-privind-desemnarea-candidatului-pentru-functia-de-Prim-ministru-neconstitutional\">According<\/a> to the <strong>Constitutional Court<\/strong>, the Parliament&#8217;s vote is essential an decisive in the procedure of appointing a new Government, as the latter is politically accountable only to Parliament (Moldova is a parliamentary republic). The CC stated that the president cannot impose her own candidate. <em>&#8220;The President is involved exclusively as a representative of the state, in order to establish and formalise through the significance and solemnity of her position and to maintain through her authority the balance between the Parliament and a possible future Government.&#8221; <\/em>In other words, the president is a mediator who must consult the parliamentary groups and, as a result, appoint a candidacy who is going to be voted (or not) by Parliament.<\/p>\n<p>At the same time, the CC concluded that the socialist candidate was submitted by a formalised majority government and that President Maia Sandu was supposed to appoint Mariana Durlesteanu for further Parliament&#8217;s voting.<\/p>\n<p>The institution noted that <span style=\"color: #993300;\"><em><span style=\"color: #000000;\">&#8220;there is no constitutional and democratic reason for the president not to appoint as a candidate for the position of prime minister the person who has the support of the formalised majority government,<\/span> even if the candidate is opposed to the President.&#8221;<\/em><\/span> The CC explained that in the situation when no political party holds the majority of seats in Parliament, the president must consult MPs not only <em>pro forma<\/em>, but to appoint the candidate who has the support of the majority government, <span style=\"color: #993300;\">even if the political party approved by the President is not part of this majority government.<\/span><\/p>\n<blockquote><p>&#8220;The president of the country should act as an authority that ascertains, but does not interpret or modify the result of elections, being constrained by the Constitution to appoint a candidate for the position of prime minister who is proposed by the political party or coalition that won the absolute majority of seats in Parliament, according to the will expressed by voters in the parliamentary elections.&#8221;<\/p><\/blockquote>\n<p>The problem here is that the structure of today&#8217;s Parliament<span style=\"color: #993300;\"> doesn&#8217;t reflect anymore the will expressed by voters at the last parliamentary elections.<\/span> Some political groups were divided and formed new political parties. Some MP&#8217;s exited one political party and joined another one (even parties with contrary views), others became fugitive or pretend to be independent. This is why there are attempts to trigger snap parliamentary elections, which, of course, are not supported by the political forces involved in such changes and who wouldn&#8217;t like to lose their seats in the legislature.<\/p>\n<p>According to the newest Public Opinion Barometer <a href=\"https:\/\/www.youtube.com\/watch?v=maukIUyL7mA\">data<\/a>, if there were snap elections in the near future, the Party of Action and Solidarity (PAS) would gather 29.6% of votes, being followed by the Party of Socialists of the Republic of Moldova (PSRM) &#8211; 16.2%, the \u0218or Party &#8211; 5.3% and Our Party (led by Renato Usatii) &#8211; 3.8%.
