16 December, 2020<\/strong> – a short-term majority government formed of socialists, some ex-democrats and the Sor Party members of Parliament (MPs) voted the Law no. 234 on the Functioning of Languages Spoken on the Territory of the Republic of Moldova<\/em><\/strong>. The law was adopted in a rush, without previous debates and contrary to the institution’s procedure, accompanied by the opposition boos and hisses. It provided that employees of state institutions were obliged to speak Russian, provide information and ensure the translation of documents into Russian<\/span>, if citizens came with requests to do so.<\/p>\n

21 January, 2021<\/strong> –\u00a0 the controversial law was declared unconstitutional by the Constitutional Court (CC), as the Court admitted the complaints submitted by 3 opposition MPs.<\/p>\n

According to the CC explanation<\/a>, the contested law grants the Russian language a status similar to that of the official state language<\/span>, as well as the possibility to benefit from preferential treatment regardless of the number of members of ethnic minority who use it<\/span>. The law discriminates the languages of other ethnic minorities who speak a language other than Russian.<\/p>\n

The Constitution of the Republic of Moldova doesn’t give the Russian language a special status from that of other languages spoken on the territory of the country. The Court noted that Article 13 <\/strong>of the Constitution\u00a0does not authorize such an option.<\/p>\n

“By giving the Russian language a status similar to that of the Romanian language, the contested law diminishes the integrative force of the official language.”<\/p><\/blockquote>\n

The Constitution of the Republic of Moldova says that the official state language of the Republic of Moldova is Romanian. <\/strong><\/span>The constitutional status of the state language implies the function of the state language to be the language of communication between all citizens of the Republic of Moldova, regardless of their ethnic origin.<\/p>\n

\n

The Romanian language is the mother tongue of at least 77.86% of Moldovan citizens. Russian is the mother tongue of at least 9.39% of them. Gagauz is the mother tongue of at least 4.08% of citizens, Ukrainian – 3.82%, and Bulgarian – 1.48% of Moldovan citizens, according to the last census performed in 2014.<\/span><\/p>\n

As the Court also noted, there are regions in Moldova where the Ukrainian language, as a mother tongue, has a higher share than the Russian language.<\/span><\/p>\n

Moreover, the CC found that the contested law was adopted in contradiction to the rules provided by the Constitution regarding the adoption of laws when involving additional budgetary expenditures. As a consequence, the law was declared unconstitutional.<\/p>\n

The representative of the Party of Socialists of the Republic of Moldova (PSRM) declared that the law would have to be repeatedly submitted to Parliament. “We attended a cheap theatrics. I noticed several speculations, manipulations from organizations that have not even read this law. We are deeply outraged. Parliament will take a stand. We do not allow the CC to replace the Parliament of the Republic of Moldova. We will resort to measures and events that come to restore the rule of law,”<\/em> claimed the socialist Vlad Batrancea<\/strong>.<\/p>\n

“The law aimed to guarantee fundamental human rights: access to information, to communicate officially with state authorities in the language you know best,”<\/em> stated Minister of Justice, Fadei Nagacevschi<\/strong>.<\/p>\n

Russian Foreign Ministry spokeswoman, Maria Zaharova,<\/strong> claimed<\/a> that the decision of the Constitutional Court would contradict the Constitution of the Republic of Moldova and that was a “regrettable decision”<\/em>, being at variance with the electoral promises of President Maia Sandu. “The verdict of the CC, which annuls the decision of the Moldovan Parliament, disappoints by the fact that, in November 2020, Maia Sandu promised she will do everything in her power to ensure that the rights of Russian speakers are not violated and asked people not to believe in horror stories. One month after her inauguration, these promises were broken,”<\/em> Zaharova said.<\/p>\n

“We hope that the leadership of the republic will have enough common sense not to cause an artificial exacerbation of domestic political tension based on language.”<\/p><\/blockquote>\n

While making the statement, the Russian official also brought wrong data, saying that “80% of the Moldovan people speak Russian.”<\/em><\/p>\n

In addition, the Russian Embassy in Moldova<\/strong> criticized the CC decision as well. The diplomatic mission described the decision as an “insult”<\/em> to the Russian state and people, saying<\/a> that “the deprivation of the Russian language from the status of the language of interethnic communication seems to be an alarming factor in the context of maintaining interethnic peace in the Moldovan multinational state.”<\/em><\/p>\n

“The Ministry of Foreign Affairs and European Integration calls on the diplomatic missions accredited to the Republic of Moldova and their members of the diplomatic staff, in the spirit of the Vienna Convention on Diplomatic Relations (1961), to respect the laws, regulations and institutions of the accrediting state and to refrains from comments, which could be qualified as interference in the internal affairs of the state,<\/span>“<\/em> replied<\/a> the representative of the Ministry of Foreign Affairs and European Integration of Moldova<\/strong>.<\/p>\n

The socialist MPs who proposed the Law no. 234 seem to ignore the fact that the Russian language is not the state language of the Republic of Moldova and it never was since the country’s independence. Therefore, Russian can’t have the same status as the official state language and it can’t hinder the official state language.<\/p>\n

The socialists also forget that the Constitution is the supreme law of the country and any law that contradicts it will be declared unconstitutional. Of course, the statements of Russian officials can support them and make them even more vocal but that doesn’t help, as they must respect the laws of the Republic of Moldova, not just adopt them.<\/p>\n

As always, the Russian language is used as a manipulative tool to divide the Moldovan society, even though its status is protected by law in the Republic of Moldova. Still, the Russian language can’t reach the status of an official state language, as the Soviet period is long over.<\/p>\n
