The law was adopted in a rush, without previous debates and contrary to the institution&#8217;s procedure, accompanied by the opposition boos and hisses. It provided that <span style=\"color: #993300;\">employees of state institutions were obliged to speak Russian, provide information and ensure the translation of documents into Russian<\/span>, if citizens came with requests to do so.<\/p>\n<p><strong>21 January, 2021<\/strong> &#8211;\u00a0 the controversial law was declared unconstitutional by the Constitutional Court (CC), as the Court admitted the complaints submitted by 3 opposition MPs.<\/p>\n<p>According to the CC <a href=\"https:\/\/www.constcourt.md\/libview.php?l=ro&amp;idc=7&amp;id=2067&amp;t=\/Media\/Noutati\/Curtea-a-examinat-constitutionalitatea-Legii-cu-privire-la-functionarea-limbilor-vorbite-pe-teritoriul-Republicii-Moldova\">explanation<\/a>, the contested law <span style=\"color: #993300;\">grants the Russian language a status similar to that of the official state language<\/span>, as well as the possibility to benefit from <span style=\"color: #000000;\">preferential treatment regardless of the number of members of ethnic minority who use it<\/span>. The law discriminates the languages of other ethnic minorities who speak a language other than Russian.<\/p>\n<p>The Constitution of the Republic of Moldova doesn&#8217;t give the Russian language a special status from that of other languages spoken on the territory of the country. The Court noted that <strong>Article 13 <\/strong>of the Constitution\u00a0does not authorize such an option.<\/p>\n<blockquote><p>&#8220;By giving the Russian language a status similar to that of the Romanian language, the contested law diminishes the integrative force of the official language.&#8221;<\/p><\/blockquote>\n<p><span style=\"color: #993300;\"><strong>The Constitution of the Republic of Moldova says that the official state language of the Republic of Moldova is Romanian. <\/strong><\/span>The constitutional status of the state language implies the function of the state language to be the language of communication between all citizens of the Republic of Moldova, regardless of their ethnic origin.<\/p>\n<hr \/>\n<p><span style=\"color: #808080;\">The Romanian language is the mother tongue of at least 77.86% of Moldovan citizens. Russian is the mother tongue of at least 9.39% of them. Gagauz is the mother tongue of at least 4.08% of citizens, Ukrainian &#8211; 3.82%, and Bulgarian &#8211; 1.48% of Moldovan citizens, according to the last census performed in 2014.<\/span><\/p>\n<p><span style=\"color: #808080;\">As the Court also noted, there are regions in Moldova where the Ukrainian language, as a mother tongue, has a higher share than the Russian language.<\/span><\/p>\n<hr \/>\n<p>Moreover, the CC found that the contested law was adopted in contradiction to the rules provided by the Constitution regarding the adoption of laws when involving additional budgetary expenditures. As a consequence, the law was declared unconstitutional.<\/p>\n<p>The representative of the Party of Socialists of the Republic of Moldova (PSRM) declared that the law would have to be repeatedly submitted to Parliament. <em>&#8220;We attended a cheap theatrics. I noticed several speculations, manipulations from organizations that have not even read this law. We are deeply outraged. Parliament will take a stand. We do not allow the CC to replace the Parliament of the Republic of Moldova. We will resort to measures and events that come to restore the rule of law,&#8221;<\/em> claimed the socialist <strong>Vlad Batrancea<\/strong>.<\/p>\n<p><em>&#8220;The law aimed to guarantee fundamental human rights: access to information, to communicate officially with state authorities in the language you know best,&#8221;<\/em> stated Minister of Justice, <strong>Fadei Nagacevschi<\/strong>.<\/p>\n<p>Russian Foreign Ministry spokeswoman, <strong>Maria Zaharova,<\/strong> <a href=\"https:\/\/www.zdg.md\/importante\/mae-rus-ingrijorat-ca-decizia-cc-va-provoca-o-exacerbare-artificiala-a-tensiunii-politice-interne-din-r-moldova-pe-baza-limbajului\/\">claimed<\/a> that the decision of the Constitutional Court would contradict the Constitution of the Republic of Moldova and that was a <em>&#8220;regrettable decision&#8221;<\/em>, being at variance with the electoral promises of President Maia Sandu. <em>&#8220;The verdict of the CC, which annuls the decision of the Moldovan Parliament, disappoints by the fact that, in November 2020, Maia Sandu promised she will do everything in her power to ensure that the rights of Russian speakers are not violated and asked people not to believe in horror stories. Of course, the statements of Russian officials can support them and make them even more vocal but that doesn&#8217;t help, as they must respect the laws of the Republic of Moldova, not just adopt them.<\/p>\n<p>As always, the Russian language is used as a manipulative tool to divide the Moldovan society, even though its status is protected by law in the Republic of Moldova.
