It is not as simple though. Indeed, the decision to dissolve the legislature is taken by the president. But the head of state can&#8217;t do it however and whenever she wants it. There are certain prerequisites to be met first.<\/p>\n<h3>The possible case scenarios<\/h3>\n<p>There are several scenarios, according to the Moldovan legislation, that could trigger Parliament&#8217;s dissolution: in case no bill is passed in Parliament for 3 months (a not working institution) or if Members of Parliament (MPs) do not appoint a Government for 3 months from the date since the prime minister resigned or was dismissed. In case MPs reject 2 candidates for the position of prime minister during 45 days, the Parliament can be dissolved earlier than 3 months.<\/p>\n<p>At the same time, the president must appoint a candidate for prime minister of the country, so that the candidacy would be later voted in the Parliament. If there was a period longer than 90 days without the president appointing a candidate for prime minister, the Constitutional Court could have the proper justification to reject Maia Sandu&#8217;s request to dissolve Parliament, as she would not fulfil her duties, experts say.<\/p>\n<p>The last option would be the legislature self-dissolution. Still, the last Moldovan Parliament was elected through a mixed electoral system, that making the self-dissolution impossible. The Central Electoral Commission (CEC) must organize new elections in each constituency, once a position of MP is vacant. Moreover, the Constitutional Court (CC) declared inadmissible the possibility of Parliament&#8217;s self-dissolution. The president of the CC, Domnica Manole, <a href=\"https:\/\/www.privesc.eu\/arhiva\/93480\/Briefing-de-presa-sustinut-de-Presedintele-Curtii-Constitutionale-a-Republicii-Moldova--Domnica-Manole--privind-declararea-ca-inadmisibila-sesizare-22\">declared<\/a> that the Constitution of the Republic of Moldova includes solutions regarding the dissolution of the Parliament before the expiration of the four-year term. The dissolution of Parliament is possible only under the conditions laid down in the Constitution and presented above.<\/p>\n<h3>Is there a reasonable solution?<\/h3>\n<p>The socialist MPs (who hold 37 seats out of 101) declared that they do not take into account the option of not adopting laws in the Parliament for 90 days. Thus, the fastest and the most reasonable solution would be that of <span style=\"color: #993300;\">MPs not voting 2 candidates as prime ministers within 45 days.<\/span><\/p>\n<p>The president shall appoint one or two candidates who would certainly not be voted by the Parliament&#8217;s majority and that would automatically lead to the dissolution of the institution, some politicians believe. <em>&#8220;The candidate must be as disliked as possible, so that if socialists [or other MPs forming a majority] vote for this Government, it should be very clear that they are afraid of snap parliamentary elections,&#8221;<\/em> <a href=\"https:\/\/www.zdg.md\/importante\/pas-inainteaza-foaie-de-parcurs-privind-anticipatele-iar-psrm-si-platforma-da-vor-ca-presedinta-sandu-sa-desemneze-candidat-la-functia-de-premier\/\">said<\/a> the vice-president of the Dignity and Truth Platform Party (DTPP), Alexandru Slusari.<\/p>\n<p>Moreover, there were already 2 self-appointed candidates for the position of prime minister &#8211; Renato Usatii, the leader of &#8220;Our Party&#8221;, the candidate who gathered <strong>16.90%<\/strong>\u00a0of people&#8217;s votes at the latest presidential election, and the leader of the Party of Communists and former President of Moldova, Vladimir Voronin.<\/p>\n<p><em>&#8220;Any nomination for the position of prime minister would lead to the postponement of the parliamentary elections and I hope that those who expressed their intention for this position are not for this postponement,&#8221;<\/em> <a href=\"https:\/\/www.facebook.com\/maia.sandu\">commented<\/a> Maia Sandu.<\/p>\n<h3>The tricky part<\/h3>\n<p>Almost all MPs declare themselves in favour of snap elections. That doesn&#8217;t mean though, that they really want it, as new parliamentary elections could mean less seats in the future Parliament for their political party.<\/p>\n<p>Given the complicated situation, the socialist leader and former President of Moldova, Igor Dodon, tried to put pressure on Maia Sandu&#8217;s decision when it comes to appointing a prime minister candidacy. His reason &#8211; total uncertainty and serious political crisis in the country.
