The Second Compliance Report<\/a><\/strong> adopted by the Group of States against Corruption (GRECO) – <\/b>a body of the Council of Europe that monitors states’ compliance with the organisation\u2019s anti-corruption standards – has been recently published.<\/p>\n

The report presents the assessments of the measures taken by the authorities of the Republic of Moldova in order to implement the pending recommendations issued in the Fourth Round Evaluation Report on the Republic of Moldova<\/strong> (adopted on July 1, 2016).<\/p>\n

According to GRECO’s report, “the Republic of Moldova had implemented satisfactorily 4 out of the 18 recommendations<\/span> contained in the Fourth Round Evaluation Report. Of the remaining recommendations, nine had been partly implemented and five had not been implemented.”<\/em><\/p>\n

The biggest concerns were raised regarding adopting and enforcing a transparent and accessible to the public code of conduct for members of Parliament (MEPs),<\/span> as well as rules according to which MEPs can interact with third parties seeking to influence the legislative process. The report also highlighted that the procedure of lifting parliamentary immunity can <\/span>“<\/span>hamper or prevent criminal investigations in respect of MEPs suspected of having committed corruption related offences”<\/em> and that no objective criteria are in place.<\/p>\n

GRECO’s representatives stated that the progress concerning MEPs activity is “clearly insufficient”<\/em>.<\/p>\n

“Still, too many laws are adopted without adequate consultation and at accelerated speed.”<\/p><\/blockquote>\n

When it comes to the judiciary of the Republic of Moldova, “the integrity requirements and testing of candidate judges for appointments and promotions are not adequately regulated as yet.”<\/em> The judicial activity, judgments and decisions, including the Superior Council
\nof Magistracy, as well as the disciplinary procedures and measures against judges are not transparent enough<\/span>.<\/p>\n

As regards prosecutors, “no progress has been made to ensure that all hierarchical interventions regarding a case are properly documented.”<\/em> Also, the recommendations regarding a code of ethics to be developed, adopted and communicated to all prosecutors, and a system of confidential counselling remained implemented.<\/p>\n

The organisation’s recommendation concerning additional measures to be taken in order to strengthen the objectivity, efficiency and transparency of the legal and operational framework for the disciplinary liability of prosecutors\u00a0 remained not implemented.<\/span><\/p>\n

“No progress has been made to review the framework for disciplinary liability of prosecutors.”<\/p><\/blockquote>\n

Therefore, the Republic of Moldova was found “not to be in compliance with the recommendations contained in the mutual evaluation report.”<\/em> GRECO asked the Head of delegation of the Republic of Moldova to provide a report on the progress in implementing the pending recommendations at the latest by September 30, 2021.<\/p>\n
