Just before International Migrants Day, the State Office of the Ombudsman in cooperation with the Law Centre for Lawyers from Moldova published the results of their jointly conducted study:\u00a0“Respecting the rights of foreign citizens who are being in the state custody.”<\/em><\/p>\n

According to a press release<\/a> published on the website of the State Information Agency, which presented the main outcomes of the study,\u00a0the national mechanisms that regulate the status of foreigners are focused on identifying the reasons for removing the foreigners from the Republic of Moldova, rather than ensuring the necessary protection for them, the legal norms do not offer effective guarantees to the applicants for protection, and the administrative bodies often abuse the assigned prerogatives.\u00a0<\/strong><\/p>\n

Especially, the study refers to the fact that the national law of the Republic of Moldova allows the return of foreigners to the territories where they could be exposed to torture, inhuman or degrading treatment<\/span>, regardless of the risk they pose to national security and public order. There are inconsistencies between the legislation on the regime of foreigners in the Republic of Moldova and the Administrative Code of the country.<\/p>\n

Infringements of existing legal framework and commitments made by Moldova within the pale of international treaties were discovered within the study. The competent authorities do not always respect the principle of non-return according to the Geneva Convention<\/span>. Therefore, it may be accused of violating the provisions of Article 33 of the Geneva Convention.<\/p>\n

Moreover, according to the study, there is no certainty that a foreign person who is detained in Moldova is provided with anti-torture guarantees (a lawyer, a doctor, informing relatives, an interpreter, the right to remain silent, etc.) until the actual documentation period. Cases of ignoring asylum applications, failure to provide access to the asylum procedure, immediate return to the country of origin or immediate take-off, detention on the territory of the airport for a long time, failure to inform the Bureau for Migration and Asylum about the arrival of asylum seekers or the delayed information about this fact<\/span>\u00a0were declared as being identified at Chi\u0219in\u0103u International Airport<\/strong>.<\/p>\n

The Law Centre for Lawyers from Moldova recorded situations where asylum seekers were declared undesirable, while still being in the administrative procedure for examining their asylum applications or immediately after an administrative decision rejecting the application for asylum was issued, without any possibility of appealing against such a decision.<\/p>\n

The trigger of the study was the case of six Turkish citizens whose rights were violated by being abducted and surrendered to the Turkish authorities in the form of a camouflaged expulsion<\/strong> (illegal transfer of persons), despite all international commitments. The State\u00a0Ombudsman condemned the decision of the authorities, at that time, and presented an opinion accompanied by recommendations in the Parliament.<\/p>\n

The study assessed the situation from 2018 to 2019, referring to the entry, stay, removal, request for protection, public custody, as well as the exit of foreigners from Moldova.<\/p>\n
