The analysis of the ECHR’s activity report<\/a> for 2018 shows that in 2018 the ECHR registered 32% fewer applications than in 2017. CRJM experts to believe that the decrease is mainly determined by ECHR’s decrease in popularity, after ECHR rejected, without clear reasoning, about 300,000 Moldovan requests in 2011-2018, which had a daunting effect on lawyers.<\/strong><\/p>\n

However, despite the reduction in registration in 2018, the number of applications filed with the ECHR against Moldova is very high if we relate it to the country’s population, with Moldova ranked 5th out of the 47 member countries of the Council of Europe. In 2018, Moldovans sent 2.5 times more to the ECHR than the European average, with the high rate of demand being explained by the lack of improvements in respecting those human rights.<\/p>\n

On December 31, 2018, 1,204 Moldovan requests are still awaiting examination, with 93% of them likely to be successful. This number is much higher than the total number of requests on which Moldova has been convicted in the last 21 years.<\/p>\n

Until 31 December 2018, the ECHR issued 387 judgments in Moldovan cases, of which 33 in 2018. In this chapter, Moldova is far ahead of Germany, Spain or the Netherlands, countries that have joined the ECHR long before Moldova and have a population much higher than that of Moldova.\u00a0The ECHR found that the Republic of Moldova did not violate the ECHR only in 6 judgments (18%) of those pronounced in 2018. The vast majority of them refer to the Transnistrian region, where the Russian Federation was condemned.<\/p>\n

The most frequent types of violations found by the ECHR in Moldovan cases are non-enforcement of judgments (old judgments), ill-treatment, inadequate investigation of ill-treatment and death, detention in bad conditions, arbitrary detention, irrecoverable judicial disqualification.<\/p>\n

Based on all decisions and decisions made by December 31, 2018, the Republic of Moldova was bound to pay over 16,640,000 euros (in 2018 – 223,050 euros).<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"
