Moreover, the international experts conclude that they regret that their recommendation not to implement the new system was not followed:<\/p>\n<blockquote><p>The remarks made in the 2017 opinion are still valid and the Venice Commission and ODIHR regret that this fundamental recommendation was not followed. It remains to be seen how the mixed system will be implemented in practice in the forthcoming elections.<\/p><\/blockquote>\n<p>The Venice Commission took note of the addressed recommendations: the establishment of a commission on constituency delimitation (though organized by the government), the measures to encourage parties to nominate women in SM constituencies, the limit of campaign finance donations decreased to 25%, and the more precise rules on provisions for voters abroad (though with deficiencies on constituencies and polling stations).<\/p>\n<p>In addition, the law experts advise reconsidering the recommendations on certain amendments like:<\/p>\n<ul>\n<li><strong>The need to lower<\/strong> the 6% thresholds for political parties and 8% thresholds for political blocks entering Parliament- the high threshold &#8220;<em>may lead to a high number of wasted votes&#8221;<\/em>;<\/li>\n<li><strong>Allocation of seats<\/strong>&#8211; the allocation formula could be revised by considering giving enough seats to small parties with large remainders after the allocation;<\/li>\n<li><strong>Representation of women<\/strong>&#8211; the Commission recommends considering additional measures to encourage women besides the lower requirements and budgetary support for female candidates;<\/li>\n<li><strong>Delimitation of constituencies (in-country)<\/strong>&#8211; a) the independence of the commission establishing the boundaries of the constituencies is doubted due to government&#8217;s involvement in it and due to its unclear composition, b) the periodic review of constituency boundaries was only partially followed by the Moldovan authorities, c) certain criteria for constituency delimitation (a number of constituencies have more than the allowed 60 thousand voters) were not followed, students&#8217; voting rights were limited to their domicile constituency;<\/li>\n<li><strong>Constituency delimitation and voting in Transnistria and abroad<\/strong>&#8211; a) voting conditions in Transnistria are jeopardized due to government&#8217;s lack of control over that territory, b) the establishment of constituencies in Transnistria based on previous voting history can result in the increased voting power of Transnistrian residents and\u00a0 advanced registration may not solve the issue, c) the process of establishing constituencies abroad should take into account the information on Moldovans living abroad from diplomatic missions and hosting countries, not only the advanced registration and voting history;<\/li>\n<li><strong>Nomination of candidates<\/strong>&#8211; a) the Commission recommends eliminating the requirement of presenting biographical data and health certificate by a candidate, b) the Commission and ODIHR recommend reducing the deadline for the late withdrawal of candidates, in order to avoid centralised control of parties over candidates;<\/li>\n<li><strong>Complaints and appeals<\/strong>&#8211; a) the complaints against electoral bodies and those against candidates should be clearly differentiated, b) deadline of one day for appeals against court decisions should be extended.<\/li>\n<\/ul>\n<p>According to <a href=\"http:\/\/sic.md\/de-ce-tac-autoritatile-despre-noua-opinie-a-comisiei-de-la-venetia\/\" target=\"_blank\" rel=\"noopener\">sic.md<\/a>, Moldovan authorities largely ignored to comment on the new joint opinion of the Venice Commission and the ODIHR, with only MP Sergiu S\u00eerbu declaring that there is no time left for implementing the recommendations, ironically invoking the Good Practices Guide of the Commission.<\/p>\n<p>According to the new electoral system, 51 MPs would be elected from electoral districts and 50 from party lists. The current edition of the electoral law also stipulates that the electoral districts would be formed by a special Government commission, composed of civil society and political parties\u2019 representatives, as well as representatives of ethnic minorities and expert bodies. The shape of the electoral districts would be published one year before the elections. Voters from Transnistria and from abroad would be represented on the geographical basis, besides their electoral \u201cweight\u201d. 7 electoral debates have been organized to debate the draft on the mixed electoral system, but a large part of the civil society and all opposition parties refused to participate and had little involvement stating that the new system does not address the real problems of the electoral process.
