On February 28th, the President of Moldova, Igor Dodon, announced in a briefing<\/a> about a draft law to modify the 85th article of the Constitution in order to get more competences.<\/p>\n

Dodon thinks that his direct election offered him a higher degree of legitimacy and responsibility towards the people. Thus, the direct election of the President would need, according to him, the necessary mechanisms of balancing the powers in the state,\u00a0ensuring in this way the coherence of the Constitution.\u00a0<\/em><\/p>\n

The President believes he would need additional cases\/conditions to dissolve the Parliament, like in Parliamentary and semi-Presidential government forms:<\/p>\n

–After consulting the Parliamentary caucuses\u00a0<\/strong>(reportedly found in the French Republic);<\/p>\n

–If the Parliament does not implement in 12 months the will of people expressed by consultation referendum<\/strong> (a decision of the Constitutional Court of Romania);<\/p>\n

–If the national referendum on dismissing the President fails because of the negative vote or the invalidity found by the Constitution Court\u00a0<\/strong>(amendment reportedly suggested\u00a0by the Constitutional Court, Venice Commission and European practice, found in Slovakia and Austria);<\/p>\n

–If the Parliament does not adopt the Law on the State Budget after two months of the beginning of the financial year\u00a0<\/strong>(found in the Constitution of Estonia and Hungary);<\/p>\n

–Dissolving the Parliament by referendum at the initiative of the President\u00a0<\/strong>(found in Estonia).<\/p>\n

Dodon asks for the help of at least a third of the Moldovan MPs to support this Constitution modification. He almost warned that, in case he doesn’t get the necessary number of signatures until March 24th, he would start a popular initiative by collecting signatures.<\/p>\n
