The Government of Moldova approved on March 30 the law that allows the investigators to access private information, like e-mail and instant messaging apps, on one hand, but also to block sites that contain dangerous or child pornography, reports Agora.MD<\/a>. According to the Ministry of Internal Affairs<\/a>, the law aims to prevent and investigate cases of child pornography and terrorism.<\/p>\n

The draft law<\/a> stipulates that the 133 article from the Penal Procedure Code will be modified in order to allow investigators to read the e-mails and the textual messengers (Viber, Telegram, Skype, Whatsapp). The law regards even the Code of Contraventions: the modifying of 247th article would introduce new obligations for the internet providers (Starnet, Orange, Moldcell), who would be obliged to filtrate and to save the content for some period, but also to block the IP adresses of some sites.
\nEven the mobile and fixed network companies will be obliged to stock the calls and messages for half a year to a year, and the Internet traffic for 6 months. <\/p>\n

The Ministry claims that the law corresponds to the norms and standards stipulated by the European Union and the Council of Europe. This contradicts to two decisions of both the Court of Justice of the EU<\/a> and the European Court of Human Rights<\/a> that conclude that general censoring and data retention are violating the human rights of free thought and privacy.<\/p>\n

Several online organizations and media outlets, like BATI, Starnet, Agora.MD, Unimedia, Diez, Privesc.EU, Ziarul Na\u021bional, Center of Journalistic Investigations and Anticoruptie.md, signed a declaration<\/a> to demand the exclusion of the new articles that would permit the investigators to block sites, check e-mail, read messages and stock information via service providers. According to them, the law would lead to heavy censorship, violation of privacy and increasing of prices for Internet and mobile services. <\/p>\n
