After the Moldovan Parliament’s approval of the new law on the General Prosecution Office and the responsibilities of prosecutors on Thursday, February 25, in less than 24 hours, the General Prosecutor Corneliu Gurin announced his resignation. The resignation will enter into effect on March 1st.<\/p>\n

“I want to thank you for the approval on the Law of Prosecution; a new chapter is being opened. I am profoundly thankful to those who participated, the colleagues from the General Prosecution Office, but also to the members of the Parliament”, stated Gurin in front of the MPs.<\/p><\/blockquote>\n

He also mentioned that “the Republic of Moldova got now one of the most progressive Prosecution laws in the EU”.<\/p>\n

The law on the Prosecution was on hold since 2009, and could not pass due to opposition of Liberals, Liberal-Democrats and especially Democrats from being approved. Yesterday, all these three caucuses and the unaffiliated deputies approved the law. <\/p>\n

According to the draft, the General Prosecutor will have a mandate of seven years and will be assigned by the President, after being proposed by the Superior Council of Prosecutors and not by the Parliament, as it was stipulated in old law. The candidates must have at least 10 years of experience in prosecution and, at the same time, not to be affiliated with a political party for at least 3 years. <\/p>\n

The prosecution will deal with only anti-corruption cases and special cases. The law also provides the rising of the prosecutors’ salaries to a 90 percent level of judges’s salaries.<\/p>\n

The law will enter into force on August 1, 2016. In order that this law to be fully functional, two other connected laws need to be approved and the 125th article from the Constitution must be changed.<\/p>\n

The prosecution system is seen by local experts and Moldova’s international donors as one that lacks professionalism and independence from politics. Thus, the previous General Prosecutor, Valeriu Zubco, and the acting one, Corneliu Gurin, reportedly served the interests of the Democrat Party, unofficially ruled by the oligarch Vlad Plahotniuc. The same practice was used by the former governments of Moldova, the Communist period of 2001-2009, when prosecution was directed against the civil society and the opposition (ex: case of Hyde Park and the cases of protesters from April 7 2009).<\/p>\n","protected":false},"excerpt":{"rendered":"
