According to the media from the left bank of the Nistru river, the new head of the Enforcement Department, former KGB officer Nicolai Zemtov, has recently reported to Sevciuk that in spite of the financial shortcomings in the order of about MDL 50 million, the prisoners will fully be provided with food, equipment and medicines in 2016.<\/strong><\/em><\/p>\n<p><em><strong> Moldova.ORG asked Alexandru Zubco, lawyer at Promo-LEX Association, for his opinion on the real situation in places of detention from the Transnistrian region.<\/strong><\/em><\/p>\n<p><strong>Mr. Zubco, we know that Promo-LEX Association provides legal aid to persons detained in the Transnistrian region. What do your beneficiaries actually invoke?<\/strong><\/p>\n<p>In their complaints, Promo-LEX beneficiaries claim to be detained in inhuman conditions (small spaces, cold concrete rooms, lack of ventilation and fresh air, lack of toilets, insufficient light, overcrowding, poor nutrition, rusty water, moisture and mold, lack of medicines, inadequate medical care, suspicious deaths, etc.) that may be regarded as an ill-treatment, affecting their life, integrity and health.<\/p>\n<p><strong>How many detention facilities are there in the region and how many people are detained there, taking into account that the Transnistrian leader claims to have pardoned 580 persons?<\/strong><\/p>\n<p>There are three prisons (one in Hlinaia and the other two in Tiraspol), a colony for minors in Camenca district and another colony for women in Tiraspol. Every town in the region has one or two pretrial detention facilities under the custody of militia. The number of persons held in prisons varies between 2000 and 2500 persons per year. The flow of detainees is much higher in militia\u2019s detention facilities. On average, there are 500-700 persons per year.<\/p>\n<p><strong>We know that international experts have visited these detention facilities, what conclusions have their reached?<\/strong><\/p>\n<p>In 2008 and 2011, two specially appointed UN experts, Manfred Nowak and Thomas Hamarberg carried out several fact-finding visits to the detention facilities from the region. They categorized the conditions of detention as unsatisfactory, which do not meet the international minimum requirements of detention.<\/p>\n<p><strong>How do you qualify the detention of persons in this region?<\/strong><\/p>\n<p>The detention facilities from Transnistria do not belong to the penitentiary system of the Republic of Moldova. The constitutional authorities do not have access to these institutions. Sometimes, the representatives of international structures have limited access. Thus, these institutions can be regarded as private, because they are illegal and led by people who have assumed these duties. And the detention of persons in such institutions is illegal and arbitrary. Moreover, the long stay in degrading conditions can be equated with the inhuman treatment.<\/p>\n<p><strong>Is there any possibility at the local level to file complaints on torture or any defense mechanisms, including complaints against the Russian Federation, which is recognized as responsible for ensuring human rights in the region? What can or should victims do?<\/strong><\/p>\n<p>There is no real and effective possibility to complain against torture and\/or ill-treatment in this region. First, because torture is not criminalized. Accordingly, victims are deprived of any effective remedy in this regard. The deprivation places are monitored by the Human Rights Commissioner and local prosecutors, who can review the complaints. Some interviewees reported that they did not trust these institutions and that after complaining their situation had worsened. However, these are the local mechanisms which, in my opinion, have to be notified in order to ascertain the allegations of mistreatment.<\/p>\n<p>There is also a judicial system that should be addressed to improve the situation. The practice shows that victims do not always use the legal safeguards for subjective and objective reasons in order to avoid the vicious circle of criminal investigation.
