{"id":441863,"date":"2016-02-24T23:35:39","date_gmt":"2016-02-24T23:35:39","guid":{"rendered":"http:\/\/www.moldova.org\/en\/?p=441863"},"modified":"2016-02-24T23:39:36","modified_gmt":"2016-02-24T23:39:36","slug":"russia-echrs-decision-in-mozer-case-contradicts-to-the-international-law","status":"publish","type":"post","link":"https:\/\/www.moldova.org\/en\/russia-echrs-decision-in-mozer-case-contradicts-to-the-international-law\/","title":{"rendered":"Russia: ECHR&#8217;s decision in Mozer case contradicts the international law"},"content":{"rendered":"<span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading Time: <\/span> <span class=\"rt-time\"> 2<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span><p>The Justice Ministry of the Russian Federation declared on February 24th, that the decision of the European Court of Human Rights in <a href=\"http:\/\/www.moldova.org\/en\/grand-court-of-echr-to-judge-a-degrading-detention-case-in-transnistria\/\" target=\"_blank\">Mozer case<\/a> &#8220;contradicts the positions of other international courts&#8221;, <a href=\"http:\/\/tass.ru\/politika\/2691739\" target=\"_blank\">reports TASS<\/a>.<\/p>\n<p>The <a href=\"http:\/\/www.moldova.org\/en\/russia-found-responsible-by-echr-in-unlawful-detention-case-in-transnistria\/\" target=\"_blank\">decision<\/a> that found Russia responsible of Boris Mozer&#8217;s unlawful and inhuman detention in Transnistria made the Russians respond as to a subjective attack:<\/p>\n<blockquote><p>After acknowledging the decision of the ECHR in the Mozer case against Moldova and Russia, &#8220;the Justice Ministry sadly find it as a continuing practice the subjective interpretation to Russia, contradicting the law principles, early issued by the UN International Court and the International Tribunal on former Yugoslavia&#8221;, stated the Ministry.<\/p><\/blockquote>\n<p>The Russians gave as a similar treatment the case of &#8220;Catan and others against the Republic of Moldova and Russia&#8221;. <\/p>\n<p>Referring to its influence over Transnistria, Russia stresses its humanitarian role in the separatist region:<\/p>\n<blockquote><p>&#8220;In regard to this, the Ministry of Justice of Russia confirms its position that the humanitarian aid given as a generally accepted by international law cannot be counted as ground for getting a state to be responsibility, unrelated to the humanitarian aid.<br \/>\nThe Ministry stresses the lack of evidence of any direct involvement of Russia in the violation of the complainer<br \/>\nThe Ministry has to recognize that there is evidence of politicization and subjective judgment in the European Court in the cases against Russia regarding the violation of human rights in the territory of Transnistrian region of the Republic of Moldova&#8221;, reads the statement.\n<\/p><\/blockquote>\n<p>Furthermore, the Ministry will act &#8220;in accordance with the international law in order to pursue the national interest in this case&#8221;. <\/p>\n<p>The Court held that Russia was to pay Mr Mozer 5,000 euros (EUR) in respect of pecuniary damage, EUR 20,000 in respect of non-pecuniary damage and EUR 4,000 in respect of costs and expenses. A separate dissenting opinion was expressed by the Judge Dmitry Dedov from Russia. <\/p>\n<p>The ECHR concluded that the Republic of Moldova, having fulfilled its obligations in respect of Mr Mozer by making significant legal and diplomatic efforts to support him, had not violated his rights under the Convention.
