The case of Boris Mozer against Moldova and Russia concerning his detention<\/a> for a suspected fraud by the self-proclaimed “Moldavian Republic of Transnistria” was analysed and judged by the Grand Chamber of the European Court of Human Rights. <\/p>\n

The Court found that Moldova didn’t violate the articles of the Convention in the case of Mozer’s unlawful detention and its inhuman conditions ruled by the court of Transnistria.
\nMoreover, the judges of the Grand Chamber found Russia responsible of violating the following articles:
\n-Article 3: Prohibition of inhuman and degrading treatment;
\n-Article 5.1: Right to liberty and security;
\n-Article 8: Right to respect for private and family life;
\n-Article 9: Freedom of thought, conscience and religion;
\n-Article 13:Right to an effective remedy.<\/p>\n

The complaints fell within the jurisdiction of both Moldova and Russia, but only the second had de facto control and influence over the separatist authorities of Transnistria and the related “Tiraspol People’s Court”.<\/p>\n

The Court concluded that the Republic of Moldova, having fulfilled its obligations in respect of Mr Mozer by making significant legal and diplomatic efforts to support him, had not violated his rights under the Convention. At the same time, having regard to its finding that Russia had exercised effective control over the \u201cMRT\u201d during the period in question, the Court concluded that Russia was responsible for the violations of the Convention.<\/p><\/blockquote>\n

The Court<\/a> held that Russia was to pay Mr Mozer 5,000 euros (EUR) in respect of pecuniary damage, EUR 20,000 in respect of non-pecuniary damage and EUR 4,000 in respect of costs and expenses. <\/p>\n
