The European Court of Human Rights will examine on February 23rd the case of Boris Mozer<\/a> regarding directly the jurisdiction of the Republic of Moldova and Russia. The case regards a number of alleged violation of Mozer’s rights by the “Moldovan Republic of Transnistria” (MRT) and its courts. <\/p>\n

According to the complaint, Mozer was arrested in November 2008 by the separatist authorities of MRT for defrauding the company for which he was working. Placed in a prison of MRT, he submitted complaints to the court about his unhealthy conditions of detention, including high humidity, lack of natural light and ventilation, overcrowding and heavy smoking in his cell. As he had bronchial astma, Mozer “suffered suffocation fits in detention”.
\nMRT’s Ministry of Justice rejected the requests in 2009, claiming that “only convicted prisoners could be transferred to a hospital”.
\nThe parent of Mozer sent several complaints to the Moldovan authorities and to the Russian Embassy in order to involve some official intervention. In February 2010, a medical board stated that Mozer’s health is not favorable, thus transferring him to another detention center, even less equipped than the initial one. <\/p>\n

One 1 of July 2010, the Tiraspol People’s Court convicted and sentenced him for seven years of imprisonment, suspended for five years. <\/p>\n

Mozer immediately fled for Moldova and went to Switzerland where he applied for asylum. <\/p>\n

His complaint to the ECHR contains the violation of the following fundamental rights:
\n-Right to liberty and security- for his unlawful arrest and detention by MRT;
\n-Right to life and Prohibition of inhuman or degrading treatment- for he was not given proper medical help in the unhealthy conditions of detention;
\n-Right to respect for private and family life+Freedom of thought, conscience and religion- for he was prevented from seeing his parents and pastor.<\/p>\n

Boris Mozer thinks that the violations regarding him fall within the jurisdiction of both Moldova and Russia.
