There are more and more young people who are interested to benefit of this companies services, therefore each year there are thousands of them traveling abroad via above mentioned companies.<\/p>\n<p>Many of them, mostly students, adventure themselves into programs like that, mainly willing to gain more experience as well as to gain some money. Often, they involve themselves into this sort of programs with ought comprehending the very details of them. On the other side, programs providing companies don&rsquo;t have means to control services quality their clients benefit of.<\/p>\n<p>In other words, many young people, citizens of the Republic of Moldova, who have the aim to find a well paid working place, go for recruitment companies like that in order to sign a working contract for Great Britain, Australia, USA and other countries.<\/p>\n<p>Even though many of Work &amp; Travel companies activate in the field on the basis of a legal permit, they make their clients to sign contracts stipulating illegal clauses, and those accept signing, being pushed by the strong willing of getting a &ldquo;job&rdquo; abroad. Also, some companies require signing, in addition to the working contract, a guarantee contract with a third party as a pledge of obligations fulfilling (for situation when the client leaves the program or doesn&rsquo;t return to Moldova in time etc.).<\/p>\n<p>Advocating the rights for people who left abroad, and who asked for legal assistance, Law Firm LEXTAL (<a target=\"_blank\" href=\"http:\/\/www.lextal.md\">www.lextal.md<\/a>) gained the trial cases in court of the Republic of Moldova, proving the judge that constraining the payment of the amount of 10 000 Euro for contract clauses disobedience is illegal. <\/p>\n<p>Moreover, LEXTAL considers that establishment of such clauses that create such a strong discrepancy between rights of the client and the rights of the recruitment Agency is against the current law.<\/p>\n<p>Some of the main contracts designed for cultural exchange programs can be declared illegal because:<br \/>\n1. people who get abroad on the basis of a contract like that, as a rule (a) are made to work, (b) are involved in alien activities then activities stipulated by the contract;<br \/>\n2. beneficiaries, de facto, aren&rsquo;t involved in activities strictly established by the contract (study English language, cultural seminars, etc.), but work;<br \/>\n3. clients don&rsquo;t benefit of support and involvement of their local coordinator, most of the time they are neglected, or even worse, abandoned;<br \/>\n4. there are other clauses of the contracts that agency tacitly breaks.<\/p>\n<p>Ones people working abroad refuse to work and start looking for a new job on the premises of the noisome and derogatory working conditions they are offered there, recruitment companies undelayed bring the third parties in the court in order to receive penalties on the basis of the signed contracts.<\/p>\n<p>In order to avoid situations like that, LEXTAL suggests that while signing a working contract, claim for at least the following compulsory clauses:<br \/>\n&#8211; information about the employer: full name and its acronym; name, surname and the position of the company manager, juridical address, other contact information;<br \/>\n&#8211; information about the work and responsabilities;<br \/>\n&#8211; working hours and vacations<br \/>\n&#8211; the payment of the migrant employee<br \/>\n&#8211; terms and conditions for the salary payment: for work during working hours (8 hours daily); for overtime;<br \/>\n&#8211; living conditions;<br \/>\n&#8211; lawfulness length of the working contract;<br \/>\n&#8211; traveling expanses responsibilities;<br \/>\n&#8211; local coordinator contact information and its responsibilities;<br \/>\n&#8211; medical and social insurance (who pays for it, on the territory of which state, insurance validity lengh).<\/p>\n<p>It&rsquo;s important to mention that a simple of the working contract signed with the employer has to be handed to it before the applicant leaves the country to work abroad. <\/p>\n<p>If the case when the working contract copy submitted to the applicant to be signed does not contain details as ones mentioned above, and the recruitment Agency refuses to communicate and clarify this information- you should be aware that terms you are going to leave the country are suspicious and they should alarm you.<\/p>\n<p>In situation when you are told that this is not a working contract, ask for detailed information regarding:<br \/>\n&#8211; the schedule for English language study;<br \/>\n&#8211; the schedule and cultural programs types;<br \/>\n&#8211; living conditions, accommodations, insurance;<br \/>\n&#8211; emergency situations;<br \/>\n&#8211; touristic destinations that follow to be visited;<br \/>\n&#8211; other important information directly connected to the program.<\/p>\n<p>The value of penalties for contract clauses violation has to be financially justified and mutual, and they should occur only if contract clauses are disobeyed. Labor legislation, as it comes, does not identify financial penalties for labor contract violation other then discipline sanctions: (a) warnings; (b) rebukes and (c) labor contract cancelation and real material prejudice compensation, if any, caused to the employer during working activity. <\/p>\n<p>In conclusion to all mentioned, LEXTAL recommends you to ask for a lawyer or a juridical company advice or at least to analyze thoroughly contracts signed with recruitment companies, to negotiate each contract clause separately in order to avoid contract hidden terms.
