The Agroindustrial Agency “Moldova-Vin” considers that the decision of the Chamber for Patent-Related Disputes of Russia (Rospatent) to withdraw the exclusive right of ownership over Barza Alba trademark on the territory of Russia is unfounded, reason for which they will appeal it to the Moscow Arbitration Court. Such a statement was made by the head of the Agency’s Legal Division, Radu Jigau. <\/p>\n

According to Jigau, the decision made by Rospatent on July 3 runs counter to the Russian legislation. The Russian company Altair SRL said that this brand has not been used in Russia over the past three years. But this is not true because the cognacs of this brand had not been exported to Russia only during the period of the ban that was in force from March 2006 to October 2007. On November 1, 2007, Moldova resumed the export of wine and cognac, including Barza Alba cognacs, to Russia. <\/p>\n

Jigau said that Russia’s food safety body Rospotrebnadzor has documents proving that Moldova did not export Barza Alba cognacs to Russia only while the ban was in force. <\/p>\n

Currently, Barza Alba, which was founded in 1978 and became one of the most famous cognac brands in the post-Soviet area, is made by Aroma Company and the Balti cognac factory. The brand is property of the State Agency “Moldova-Vin”. <\/p>\n
