„Oferta Plus” Ltd won on Tuesday the trial which the Government of the Republic of Moldova had been put to at the European Court of Human Rights (ECHR). The Court decided that the Government will pay the victim 2,5 million Euros as material damage, 25 thousand euros – moral damage and 10 thousand euros – expenditures of trial, DECA-press Agency transmits.
\n„Oferta Plus” Ltd delivered in the period of 1997-1998 electric power in the Republic of Moldova of over 33 million USD. A part of this power was consumed by the budget institutions, which didn’t pay for a part of the consumed power. The demandant obtained in 1999 a judicial decision by means of which the Ministry of Finances was obliged to pay the amount of 20 million lei.
\nThe judicial decision from 1999 hasn’t been executed until 2003. In December 2003, the demandant and the Ministry of Finances have concluded an agreement of execution of the decision in a term of ten months. The agreement was executed only for 2,5 months, after the reclaimant had been informed that this one would not be executed anymore.
\nIn April 2004, the reclaimant field a complaint at ECHR. After that, the Ministry of Finances field a demand of revision at the Plenary sitting of the Supreme Court, which, on July 12th 2004. closed the decision from 1999 and sent the case for rejudgement. As a result of the reexamination of the case, the Supreme Court rejected the requirements of the reclaimant in February 2005.
\nOn February 4th 2007, „Oferta Plus” Ltd asked the Supreme Court to cancel its decision from July 12th 2004 and maintain the decision from 1999. On October 29th 2007, the Court ordered that the decision from 1999 „will not be executed”. Thus, „Oferta Plus” Ltd was deprived of the right to receive the sums offered by means of the decision from 1999.
