The European Court of Human Rights (ECHR) passed judgments in the Malai versus Moldova and Russu versus Moldova cases on November 13. The Government of Moldova was found guilty in both of the cases and ordered to pay 6,000 euros. <\/p>\n

In the first case, the applicant, Nicolai Malai, is a Moldovan national who was born in 1963 and lives in Chisinau. In November 2004, charges were brought against him for unlawful fishing. Shortly after a detention warrant was issued against him. He was, however, only arrested in December 2005. He was released in January 2006 when the detention warrant expired. The criminal proceedings against him were terminated in October 2006 and he was ordered to pay a fine.

\nThe case concerns his complaint about the unlawfulness and conditions of his pre-trial detention. He relies on Article 5 (right to liberty and security), 3 (prohibition of inhuman or degrading treatment) and 13 (right to an effective remedy). The Court awarded the plaintiff 3,500 euros in respect of non-pecuniary damage and 1,500 euros for costs and expenses. <\/p>\n

The second applicant, Alla Russu, worked as a journalist for the national public broadcaster Teleradio-Moldova. According to the applicant, on 27 July 2004 a spontaneous strike began amongst the company’s staff in response to alleged censorship and disrespect for democratic principles enforced within Teleradio-Moldova by the Communist Party. The applicant was among a group of staff who occupied a room and refused to vacate it until their demands were met. According to the Government, this was an unauthorized demonstration. <\/p>\n

The applicant was found guilty of breaching Article 174\/1 § 4 of the Code of Administrative Offences by actively participating in an unauthorized demonstration. She was fined 180 Moldovan lei (12 euros at the time). The Court awarded 1,000 euros in respect of non-pecuniary damage to the plaintiff. <\/p>\n

Moldova was included in the list of the top 12 countries with the largest number of applications at the ECHR. As many as 2,350 applications were filed against Moldova during November 1999 and October 2008.<\/p>\n","protected":false},"excerpt":{"rendered":"
