The law draft on the juridical statute of adoption, which stipulates its procedure and the execution of the stipulations of the international Convention on national and international adoptions, was approved by the Government. <\/p>\n

The document stipulates the juridical reports on protecting the child’s rights through adoption, the juridical statute of the adoption and the international cooperation in the field of the child protection. It settles clear phrases referring to the authorities’ competencies empowered in the adoption process, a stricter monitoring of the child and family in the post-adoption period. According to the law draft, during the adoption procedure, the guardianship authority is obliged to offer the child clear and complete information on the adopting person or family, and his or their relatives. During the adoption process, they will take into account the feelings of the child, as well as his ethnical origin, allegiance to a specific culture or religion. <\/p>\n

The document stipulates, a person up to 18 years old may be adopted, with the exception of that who acquired the full capacity of exercise by this age. This person may be adopted only if the adopting person or family is the one that bred this child. The adopting people may be represented by adults over 25 years old or are at least 18 years old older than the person to be adopted. <\/p>\n

The adopting procedure takes necessary measures so that the brothers are adopted together, if possible. <\/p>\n

The adoption among brothers is forbidden, as well as the adoption by more people, except the case when it is done by the husband and wife simultaneously or consecutively. <\/p>\n

The diplomatic missions and the consular offices of Moldova from abroad are to issue the interested people information on the children’s rights in Moldova and to keep evidence of the Moldovan children adopted by citizens of the state they have residence permit in or by the Moldovan citizens with the residence permit in a foreign state, according to the law draft. The law draft was presented to the Parliament for examination. In late February, Moldova’s President Vladimir Voronin requested the finishing and adopting procedure of the law draft regarding the juridical statute of the adoption to be urged <\/p>\n

Two the most relevant treaties regarding the adoption for the European states are the Convention from Haga 1993 and the Convention of the Council of Europe regarding the adoption 1967, which treats the problem of the national adoption.
