Former Moldovan Minister of Defense Valeriu Pasat was released on Monday by decision of the Chisinau Appeals Chamber, his lawyer Gheorghe Amihalachioae told Infotag. <\/p>\n

The lawyer explained that the Pasat case fell under the force of the 2004 Amnesty Law on the occasion of the 10th anniversary of the Constitution of the Republic of Moldova. According to that law, all convicts serving sentences of 7 years and shorter are subject to amnesty. <\/p>\n

Last several months, the Chisinau Appeals Chamber and the Supreme Court could not decide which of them was supposed to pass a final decision, and were constantly adjourning the case. <\/p>\n

Lawyers, in their turn, lodged applications on changing the measure of restraint for Pasat because, formally, he was a person under remand. Nevertheless, Valeriu Pasat had long been kept in a remand prison. <\/p>\n

Last July 4, the Supreme Court had once against sent the Pasat case back to the Appeals Chamber. Earlier, the Supreme Court arrived at a conclusion that during the case examination in the lower judicial instance lots of procedural violations were made. The Supreme Court agreed both with the arguments of the lawyers who had challenged the primary instance’s sentence – 10 years in prison and with the arguments of prosecutors who had challenged the Appeals Chamber’s decision on reducing the sentence down to 5 years from the initial 10 years. <\/p>\n

Valeriu Pasat, the former Moldovan Minister of Defense and former Director of the Information and Security Service (ISS) and currently de-jure Adviser to RAO EES [United Energy Systems of Russia] President, was arrested in March 2005 on suspicion of abusing office when Minister of Defense (1997-1999) by selling to the United States 21 unused MiG jet fighters, and to other buyers – unused missile systems. <\/p>\n

The General Prosecutor’s Office maintained the weaponry was sold "too cheap", and, as a result, those transactions inflicted, allegedly, a US$55 million damage to the Moldovan State. <\/p>\n

Valeriu Pasat kept on refuting all the accusations, claiming that all that was but a political reprisal by the Moldovan Communist authorities for his criticizing Moldovan President Vladimir Voronin. Nevertheless, the Sectorul Centru Court of Chisinau sentenced Pasat to 10 years in prison in January 2006. <\/p>\n

However, already the following month the General Prosecutor’s Office brought new official charges against Pasat, this time on much graver Articles of the Criminal Code – an attempted seizure of the state power and preparation of a premeditated murder to promote the committing of another crime. <\/p>\n
