The European Court of Human Rights (ECHR) is examining the second case filed by political prisoners of the Tiraspol regime Andrei Ivantoc and Tudor Petrov-Popa, members of the Ilascu Group. <\/p>\n

Contacted by BASA, Vladislav Gribincea, lawyer of the organisation Lawyers for Human Rights, said that the case is being examined on basis of applications lodged by Andrei Ivantoc, his wife Eudochia Ivantoc, Tudor Petrov-Popa and his son Victor Petrov on June 10. "They sought the sentencing of the Moldovan and Russian governments, accusing them again of non-execution of the July 8, 2004 ECHR judgment" on release of the two prisoners. <\/p>\n

He explained that the applicants invoke the violation of their rights guaranteed by Articles 3, 5, 8, 13 and 46 of the European Convention on Human Rights, which prohibit the torture, guarantee the rights to freedom and safety, private life, an effective appeal and mandatory execution of ECHR judgments. <\/p>\n

Asked to comment on this case, Romanian Senator Ilie Ilascu, former political prisoner of the anti-constitutional Tiraspol regime, told BASA that the Chisinau authorities should take unordinary measures and negotiate with the Russian Federation the release of his comrades who still are in the arbitrary detention of the illegal Tiraspol regime. <\/p>\n

"The Committee of Ministers of the Council of Europe), which is in charge with verifying respect for ECHR judgments, has issued four resolutions warning Russia over non-execution of the July 8, 2004 ECHR judgment. The Russian Federation has defied the ECHR as international and European court of law in all possible ways until now," Ilascu added. <\/p>\n

\"\"The ECHR asked the Chisinau and Moscow governments on March 29 to comment on application of political prisoners Ivantoc and Petrov-Popa. Russia said in explanations to the European Court that "it does not control the Transnistrian territory," while the Moldovan government said that it does its best to release the two prisoners. <\/p>\n

Also, Moldovan ombudspersons Raisa Apolschi, Iurie Perevoznic and Ivan Cucu appealed to the human rights commissionner of the Council of Europe, Thomas Hammarberg, this week to mediate the situation and to help release Andrei Ivantoc and Tudor Petrov-Popa. <\/p>\n

Ilie Ilascu, Alexandru Lesco, Tudor Petrov-Popa, Andrei Ivantoc, Petru Godiac and Valeriu Garbuz were jailed on June 2, 1992, with the unrecognised Transnistrian authorities accusing them of war crimes and terrorism.
