\"\"The size of the damages for defamation will be set by the court taking into account certain criteria, according to the amendments to the Civil Code formulated by MPs together with representatives of courts of law and NGOs. <\/p>\n

According to the Parliament’s press service, Speaker Marian Lupu said the new amendments to the Civil Code extend the list of criteria used to assess the moral damage caused. Under the amendments, the size of the damages will be set according to the following criteria: character of the information spread, sphere where the information is spread, social impact on the libeled person, gravity of the physical and psychological sufferings experienced by the defamed person, proportionality between the damages to be paid and degree to which the reputation is harmed, guiltiness of the defaming person etc. <\/p>\n

Deputy chairwoman of the Parliament Maria Postoico said that European countries’ legislation does not stipulate minimum or maximum rates for assessing the damage caused by libeling. The court decides on the size of the damages resulting from the specifics of each case apart. <\/p>\n
