The Sectorul Centru Court of Chisinau will reach a verdict on the Pasat\/MIG case before the end of this year, maintains Valeriu Pasat’s lawyer, Chairman of the Moldovan Bar Association George Amihalachioae. <\/p>\n

Today, Moldavskiye Vedomosti newspaper of Chisinau has published an interview with the prominent jurist, who said that the sides’ pleadings will be held on December 8, and the defendant will say his last plea. <\/p>\n

Then the Judge will take a break to formulate a verdict. Its substantive part can be written in a matter of half-hour. After that, the verdict’s motivation part is to be shaped and formulated, which may take up to 10 days. Therefore, at any rate the verdict is to be heard before the end of 2005, the lawyer said. <\/p>\n

He expressed regret that the Court had refused to attach to the case the evidences provided by 2 American witnesses who had a direct relation to the transaction of buying Moldovan MIG-29 jet fighters by the United States. These witnesses are Mr. E. Wayne Merry, a former U.S. State Department and Pentagon official and now Senior Associate at the American Foreign Policy Council in Washington, who held the negotiations on purchasing the said MIGs by the United States, and the then U.S. Ambassador to Moldova Mr. John Todd Steward, who controlled the MIG contract enforcement. <\/p>\n

In the lawyer’s, they confirmed the contract’s full legitimacy and benefit for Moldova and, accordingly, Pasat’s innocence. The evidences were duly documented and certified with the rubber stamp and signature of a U.S. notary, of the Moldovan Embassy in Washington, and were signed by U.S. Secretary of State Condoleezza Rice. However, Judge Lilia Vasilevici has refused to attach the documents to the case due to some formal irregularities. <\/p>\n

At the same time, George Amihalachioae pointed out that the Chisinau Court took notice of the reply he had received from Russia from the MIG aviation-building corporation and the RosOboronExport [“Russian Defense Exports”] state company. They provided an assessment of the technical condition of the MIGs in question, manufactured in 1984-1990, and indicated their approximate cost. According to those documents attached to the case all right, each of those MIGs could cost $200 to $300 thousand at that time, “which was practically the cost of the metal scraps”. The United States paid $40 million for those aircraft. However, the then Minister of Defense Valeriu Pasat is being accused of inflicting a $53 million damage to the Moldovan State. <\/p>\n

Amihalachioae maintains that the Court has committed various law violations, and one of them was the violation of Pasat’s right of protection, namely the defendant has the right to choose any lawyer, but Valeriu Pasat was denied the right to hire foreign layers. <\/p>\n

“The Court has breached not only the domestic legislation but also Article 6 of the European Convention on Human Rights. For that reason alone, Pasat is going to win the case in the international court”, stated George Amihalachioae. <\/p>\n

He emphasized, the Pasat\/MIG case is being very closely followed by international human-right and juridical organizations, and is being waited for in Washington, Brussels and Moscow. <\/p>\n

“The verdict may trigger an enormous international scandal which Moldova does not need whatsoever. From the legal viewpoint, there are no grounds for imposing a judgement of guilty, because there exist no evidence of Pasat’s being guilty. Witnesses’ testimonies, other materials speak only in favor of Valeriu Pasat. So, if to obey the letter of the law, Pasat must only be justified. However, you may expect anything from the Moldovan Court”, said the lawyer. <\/p>\n

Amihalachioae stated that even with the naked eye one can notice a political order in the Pasat case, and the interests of the country’s top personalities and power echelons. <\/p>\n

“This is but an overt reprisal against a political rival and dissident.
