The court decided Tuesday to release the former chief of the architecture department in the Chisinau City Hall, Vladimir Modirca. <\/p>\n

Contacted by BASA, Nicolae Ursu, lawyer of Vladimir Modirca, said that his client will be arrested at home until the court passes a ruling in this regard. Ursu noted that he does not know why his client was released from the OSCE Penitentiary # 29, but h e presumes that this decision may be related to the fact that the European Court of Human Rights (ECHR) is expected to pass a ruling on this case after ten days. The lawyer expressed conviction that the ECHR would award victory to Modirca. According to Ursu, there were no relevant reasons to hold and detain his client. <\/p>\n

Ursu underlined that he had early appealed the court to withdraw the accusations against Modirca, but the court turned down his appeal. <\/p>\n

He stressed that all the witnesses heard on behalf of the accusation said that Modirca is innocent and testified in his favour. <\/p>\n

The Centre for the Struggle Against Economic Crimes and Corruption (CCCEC) filed a case against Vladimir Modirca, Alexei Cebanenco, deputy chief of the land directorate in the Chisinau City Hall, and former deputy mayor of Chisinau Ion Paladi on July 29, 2004. The Centru district court of the Chisinau municipality started examining this case on November 1, 2004. <\/p>\n

Modirca, Cebanenco and Paladi face charges of abuse and misuse of post and negligence. The anti-corruption centre CCCEC said they had allegedly used their posts to furnish purposely inaccurate information to the City Hall and that their actions, which fo llowed a personal benefit, had led to the illegal acquisition of a 0.42 hectare plot adjacent to the National Museum of Arts by the firm Monte Nelly Srl, harming the state by about 10 million lei (some 830,000 dollars). <\/p>\n
