Secretary of Chisinau Municipal Council (CMC) Vladimir Sarban, who was arrested in November 2004 on a charge of abuse of power, was set free from preventive custody on Wednesday under the decision of the European Court of Human Rights (ECHR) from October 4 this year. <\/p>\n

Sarban’s lawyer Nicolae Ursu told REPORTER.MD that his client was released on Wednesday morning at a hearing where the ECHR decision on the case of Sarban versus Moldova was made known. ECHR convicts Moldova of violation of article 3 of the European Convention on Human Rights (interdiction of inhuman treatment) and article 5 (right to freedom and safety). <\/p>\n

The court has changed the preventive custody into home arrest on condition that the accused be present in court whenever summoned. <\/p>\n

According to Ursu, the decision of the Court in Strasburg is valid also for other City Hall employees arrested last autumn. <\/p>\n

The Center for Combating Economic Crimes and Corruption (CCECC) accuses Sarban of introducing on purpose the phrase “…and signature of the contract…” in the CMC decision dated December 12, 2002, while the councilors voted for the decision of empowering the Mayor of Chisinau only with the right to negotiate the terms of the contract the object of which was the purchase on leasing of 40 ambulances for the Municipal Emergency Hospital. <\/p>\n

“In such a way, the secretary of the Chisinau Municipal Council has intentionally and unilaterally given organizational-economic rights to the Mayor of Chisinau Municipality, exceeding his authority and committing a corruption offense. The illegal actions of CMC secretary defrauded the municipal budget of 4,134,900 lei”, says a CCECC communiqué. <\/p>\n

Ex CCECC criminal investigation officer Grigore Gorea, who was examining the case of the ambulances, had previously stated that he was forced to open a legal case against the CMC secretary Vladimir Sarban and to declare the ex General Mayor of Chisinau Serafim Urecheanu guilty without a legal basis. \/\/ Reporter.MD<\/p>\n","protected":false},"excerpt":{"rendered":"
