\"\"The European Court of Human Rights (ECHR) condemned the Republic of Moldova in the case of Rosca versus Moldova, for not respecting the right to a fair trial. <\/p>\n

Chisinau inhabitant Ion Rosca had a misunderstanding in 1999 with a bank, concerning the reimbursement of two thousand shares. He sued the bank seeking moral and material damages. The court of law decided in favor of the plaintiff, offering damages of over 100 Th. lei. <\/p>\n

On 11 July 2001, the Supreme Court of Justice (SCJ) cancelled the decision of the lawcourt on the basis of a request of the General Prosecutor’s Office. <\/p>\n

The plaintiff submitted a request to ECHR in which he asserts that the SCJ decision contravenes art. 6 § 1 (right to a fair trial) and art.1 of Protocol nr.1 (protection of property). <\/p>\n

ECHR recognized the violations of the international acts and granted to the plaintiff 3 500 Euros for material damages, 2000 Euros for moral damages and 690 Euros for trial expenditures. <\/p>\n
