The Venice Commission says the Moldovan Parliament’s decision to prohibit the use of communist symbols (hammer and sickle) goes against the European Convention of Human Rights.<\/p>\n

Moldova’s envoy to the Venice Commission, Nicolae Esanu said this decision violates Articles 10 and 11 of the European Convention of Human Rights with reference to freedom of expression, Publika TV reported.<\/p>\n

The Venice Commission is the Council of Europe’s advisory body on constitutional matters which encompasses 58 member states. <\/p>\n

Mr. Esanu added that the experts of the Convention said the law should be qualified as unconstitutional and abolished. According to him, such a move would prevent Moldova from being convicted again at the European Court of Human Rights.<\/p>\n

The law in Moldova says that “dissemination and\/or use for political purposes of symbols of the totalitarian communist regime (hammer and sickle and any support to these symbols), as well as promotion of totalitarian ideologies on the territory of the Republic of Moldova shall be sanctioned by a fine of 100 to 150 conventional units applied for individuals and by a fine of 300 to 500 conventional units applied for persons holding responsible positions and legal entities.”<\/p>\n

Communists used the symbols during electoral campaigns. They were very outraged after the hammer and sickle were banned, since they were as a benchmark for the party during voting process. People automatically identified the symbols with the Communist Party.<\/p>\n
