On January 19 expired the three-month deadline given by the European Court for Human Rights (ECHR) to the Russian Federation in the case of Latin-script schools from Transnistria. According to the ruling, Russia was supposed to respect its obligations towards the complainants (three high schools that teach in Romanian, using the curricula provided by central government in Chisinau): to pay the plaintiffs 1.2 million Euro moral injuries and return the buildings of the high schools which were levied. ECHR condemned Russia on October 19, 2012 ruling that the country had violated the right to education of Moldovan students studying in Transnistria [which is controlled by Russian forces and it is supported financially, economically and politically by Russian Government].<\/p>\n

Why did not Russia comply with the ECHR decision, given that it is a Council of Europe’s member and it undertook the responsibility to respect the decision of this resort? Two days after the Court issued the decision, Russian Foreign Ministry released a press statement claiming that the ECHR’s decision is “unfair and tendentious.” However, that is not the reason why Russia – member of the Council of Europe – did not comply with the decision.<\/p>\n

I believe that the Russian leadership understood that by applying the former ECHR decisions (in 2004 – in the Ilascu vs Russia case; in 2011 – in Ivantoc and Popa vs Russia case), the myth – misleading the international public opinion that the conflict in Eastern Moldova is not being carried between Russia and the Republic of Moldova (the signatories of the 1992 Agreement “Regarding to the peaceful settlement principles of the armed conflict”), but between the Transnistrian region and Moldovan state – can fade away.<\/p>\n

According to this myth – framed in the “5+2” talks –, Russia is a “mediator” and “guarantor.” To make this myth more credible, Moldova and the Transnistrian leadership became equal sides in the “5+2” talks since April 2012.<\/p>\n

The case of non-compliance in the ECHR’s decision concerning those three Romanian language schools in Transnistria is unprecedented. Russia neither paid anything, nor offered any explanations.<\/p>\n

Its decision might mock the ECHR, which seems to have annoyed Moscow, because Russia wants to further keep its troops in Eastern Moldova, thus keeping Moldova in its sphere of influence. Virtually, Russia would like to continue to control the region throughout its intelligence agencies and military, but at the same time to be a “mediator” and “guarantor” in the “5+2” talks, as if it was not militarily involved in the conflict since 1992.<\/p>\n
