\nThe Government of the Republic of Moldova has lost a new case in the European Court of Human Rights, which ruled that the Moldovan authorities had violated citizen Eugen Sofranschi’s right to free expression.<\/p>\n

Teodor Cirnat, Executive Director of the Moldova Helsinki Committee for Human Rights (MHC), told your Infotag correspondent that in the run-up to the 2003 local elections, Sofranschi strongly criticized the Mayor of Briceni Town, Veaceslav Baran, for his abusing of power and position when holding his previous post – director of a large cattle-breeding farm.<\/p>\n

"Sofranschi sent a letter to then-President Vladimir Voronin, in which he called Baran "impudent", writing that Baran had no education or experience whatever for heading such a serious enterprise, and that he had received the post contrary to the law. Voronin did not take any measures in response to the letter. And after the elections, in which Communist Party member Veaceslav Baran was re-elected as Briceni Mayor, he decided to tolerate the criticism no further, and sued Sofranschi in court, having demanded a 20,000-lei compensation for moral damage", said Teodor Cirnat.<\/p>\n

Though Sofranschi simply resorted to his right of opinion expression, Moldovan court instances ruled that he must reimburse the claimed moral damage.<\/p>\n

Cirnat said, Sofranschi then appealed for justice to the ultimate instance – the European Court of Human Rights, which arrived at a conclusion that the plaintiff was really strongly critical in his letter to the President, but used a polite, civilized language which did not cause a personal insult, and that the Moldovan court instances breached the citizen’s freedom of expression.<\/p>\n

As a result, the ECHR ruled that the Government of Moldova must repay \u0432‚¬5 thousand to Sofranschi as compensation for material and moral damage, said Teodor Cirnat.<\/p>\n","protected":false},"excerpt":{"rendered":"
