The incumbent Parliament of Moldova must be dissolved no matter the September 5 referendum outcome, Constitutional Court Chairman Dumitru Pulbere stated to the press on Monday.<\/p>\n

He said that even if the referendum decides that president of Moldova should be elected by a direct vote of the whole nation, Acting President Mihai Ghimpu must disband the legislative forum immediately after September 5. Moreover, the acting president ought to consult the Constitutional Court concerning the parliamentary dissolution procedure.<\/p>\n

"In any way, no matter what citizens vote for at the referendum, the Constitutional Court shall be abiding in its decisions by the legal norm that existed as on the date of the dissolution problem emergence. This problem appeared on June 16, when, as per the incumbent Article 78, the Parliament should have been dissolved straightaway", said Dumitru Pulbere.<\/p>\n

He stressed that from the viewpoint of legitimacy, the mandate of an acting president is inferior to that of a president’s.<\/p>\n

Asked by journalists if Communist Party leader Vladimir Voronin has the right to stand for presidency once again, the CC Chairman said that if only such inquiry is sent in, the Constitutional Court will present its opinion on the issue.<\/p>\n
