Moldovan Minister of Justice Alexandru Tanase has voiced an utter disappointment over the Constitutional Court opinion that Ion Muruianu was dismissed contrary to Main Law principles.<\/strong><\/p>\n

In early March, 52 MPs from the majority Alliance for European Integration in the 101-member Parliament of Moldova voted for removing Ion Muruianu because Moldova had allegedly lost too many cases at the European Court of Human Rights through his fault, and because he had compared some local journalists with "a pack of rabid dogs". His dismissal was then demanded by a group of prominent Moldovan journalists, who regarded his words as an attack against the press. The opposition Communist faction stood up in his support, and applied to the Constitutional Court to examine the dismissal from the point of view of meeting constitutional norms. <\/p>\n

On Tuesday, the Constitutional Court of Moldova has arrived at a conclusion that Ion Muruianu was dismissed as Supreme Court Chairman contrary to constitutional norms. <\/p>\n

Tanase told a briefing saying that the Constitutional Court "had no moral right to cancel the political decision passed by parliament on Muruianu’s removal".<\/p>\n

Alexandru Tanase stated he had been informed about the Constitutional Court’s forthcoming verdict yet last week.<\/p>\n

"Already then, a banquet hall was booked in advance at an expensive restaurant – to mark the occasion. I regard this CC decision as a political one, taken on the pressure by certain personalities interested in having Muruianu on the post and in his resuming control over the administration of justice in Moldova. This is the logic of the Communist Party, which has created a Mafioso system and used the judiciary system in their interests – through Muruianu", Tanase said.<\/p>\n

He believes this CC judgment may prompt other dismissed Communist bureaucrats to applying to courts, and "this may lead to a chaos in the country. Even if the Constitutional Court ruled the Muruianu’s dismissal was contrary to the Constitution, he shall not be reinstated in his previous position".<\/p>\n

In the nearest future, he said, a contest will be announced for filling the vacant post of the Constitutional Court chairperson. In his opinion, the best candidacy for it is Mihai Poalelungi, currently a Judge of the European Court of Human Rights.<\/p>\n","protected":false},"excerpt":{"rendered":"
