CC declares constitutional norms banning officials on holding dual citizenship<\/strong><\/p>\n

Moldova’s Constitutional Court (CC) on Tuesday declared as constitutional the legislative norms banning officials from holding dual citizenship. The decision is final, cannot be appealed, and entered into force on the date of adoption. <\/p>\n

MP Vlad Filat appealed against these norms in the CC. He said that they run counter to the European Convention of Human Rights (ECHR). <\/p>\n

The head of the CC, Dumitru Pulbere, said that any sovereign and independent state has the right to assess and establish certain conditions towards its citizens, no matter their status, either MP, judge or ordinary citizen. <\/p>\n

Pulbere specified that, while adopting the decision, the CC took into account including a decision by the ECHR on the same subject, which is now considered by the Grand Chamber of the Court, with a final decision due to be issued next autumn. <\/p>\n

‘During ten days at the latest, the CC will publish the entire decision which was approved on Tuesday in the Monitorul Oficial (Official Paper). The document includes serious arguments by which the judges guided themselves. By this text, we endeavoured to hint to the ECHR and other European institutions that Moldova observes all the international documents which the country is party to,’ the head of the CC said. <\/p>\n

The law which prohibits people with public offices from holding dual citizenship entered into force on 13 May 2008. <\/p>\n

The restrictions regard the post of Moldovan president, minister, MP, judge, policeman, employee of the Security and Information Service, etc. The newly elected lawmakers fall under these norms too. Twenty one of these MPs hold the citizenship of another state, or submitted documents to get it.
