Lawyers’ failure to file paperwork on time has taken away the final death penalty appeal for nine men in Texas, including six who were executed, records show.<\/P>

The Houston Chronicle reported Sunday that in the most recent case the Texas Department of Criminal Justice executed Johnny Ray Johnson for the rape and murder of a Houston woman after Johnson’s defense lawyers missed a federally mandated filing deadline by one day. One of his attorneys, Jerome Godinich, made the same mistake in the case of death row inmate Keith Steven Thurmond, the newspaper said.<\/P>

Godinich, in both cases, waited until after business hours on the last day an appeal could be filed and then blamed a malfunctioning filing machine for being late.<\/P>

The Chronicle reported that it reviewed records in nine appeals that were filed too late. The newspaper said it found that lawyers or judges appear to have miscalculated or misunderstood the dates of the deadlines, which generally fall one year after state appeals are concluded.<\/P>

Any decent judges would be deeply ashamed of the quality of legal representation in most capital cases in Texas,<\/Q> said Stephen Bright, who directs the Southern Center for Human Rights in Atlanta. The very least they could do about it would be to prohibit lawyers who miss the statute of limitations from taking another case and referring them to the Bar for disciplinary proceedings.<\/Q><\/P><\/p>\n","protected":false},"excerpt":{"rendered":"
