The decision of the Chisinau Municipal Council (CMC) dated November 30, which provides for the reorganisation of the two municipal stations via alienation, contravenes the Civil Code. According to the municipal councillor Oleg Cernei, this fact is confirmed by an informative note of the Parliament in response to the interim mayor Vasile Ursu’s request. <\/p>\n

Cernei said at the CMC session, which took place Tuesday, December 26, that Ursu addressed the Parliament concerning the reorganisation of the 2 stations. The Parliament responded that the decision on the reorganisation via alienation violates the Civil Code, which stipulates that a legal person can be reorganised via merger, dismemberment or transformation. <\/p>\n

Also, Cernei states that the informative note recommends the CMC to change this decision until December 30 so it would comply with the provisions of the Civil Code, because otherwise it is liable to legal action. <\/p>\n

Cernei solicited to include this issue in the agenda and asked Ursu to show the councillors the letter from the Parliament. <\/p>\n

Vasile Ursu confirmed the existence of the informative note, mentioning that its was signed by the chairman of the specialised Parliamentary Committee, Victor Stepaniuc and by the head of Parliament’s Legal Department, Ion Creanga, but he said that Cernei misinterpreted content of the document. According to Ursu, the authors of the note consider that the CMC has enough levers in order to follow the provisions of the Civil and Broadcasting Code and to carry out the reorganisation. <\/p>\n
