Moldovan President PetruLucinschi has stood up with a legislative initiative onbroadening the authority of the executive power branch.<\/p>\n

According to the presidential Press Service, the head of statehas submitted a draft law for parliament’s consideration,proposing "to invest the Government with a 2 year long authorityto adopt normative-level regulatory enactments — Resolutionshaving the force of law which shall be regulating publicrelations pertaining to Budget implementation, privatization,tax policy, social insurance, social protection, as well asrelations not regulated by law.<\/p>\n

The President has proposed to furnish the Government with theprivilege of speedy legislative procedure which presupposes theGovernment’s right to request the Parliament to express (during72 hours) its attitude to certain draft laws which theGovernment regards as urgent or priority-important. In suchcases, the Parliament must put the Government-proposed draftlaws to vote within the specified time, or to consider them aspassed in the proposed version, and to send the document forpresident’s promulgation.<\/p>\n

The Lucinschi-proposed draft law envisages also that withoutGovernment’s consent the Parliament shall not be in a positionto initiate passing laws in the fields of finance, including onamending the State Budget, on setting, cancelling, revising oftaxes and the tax system as a whole, as well as to introduceamendments to the existing legislation should these changes leadto public finance spending.<\/p>\n

The initiative proposes also to invest the prime Minister withauthority to begin, if need be, forming a new government uponconsultations with parliamentary parties, being guided in thiswork by the professional skills, compatibility and the unity ofconvictions of its members. The draft law supposes also, indefiance of current legislation, to provide the Government withthe right to independently resolve matters of itsre-organization and order of work.<\/p>\n

In his covering letter to parliament, President Lucinschiexplained the necessity of passing this law due to "thecrisis-like situation which has emerged in various spheres ofactivities of the public administration, first and foremost inthe Government’s activity", as well as due to "the necessity tocreate a legal frame for forming a strong government equippedwith sufficient authority to carry out its constitutional dutiesand successfully resolve the global problems of the society".<\/p>\n

The President’s initiative is believed to be considered withoutdelay, but only after a vote of confidence is passed in the newgovernment being formed at the moment by Serafim Urechean.<\/p>\n
