As for the external trade by Transnistrian enterprises (which is fixed in the 1997 Memorandum), it must be run in conformity with the Republic of Moldova&#8217;s national legislation, international law, and Moldo-Ukrainian bilateral agreements that in no way infringe on the Transnistrian companies&#8217; rights or in contravention with the 1997 Memorandum or with Moldova&#8217;s WTO commitments. <\/p>\n<p>The Ministry reminded that the Memorandum was one of the documents of the negotiation process, and was signed in a package with the Joint Statement made by the Russian and Ukrainian Presidents with participation of the OSCE Chairman-in-Office on the request of the Moldovan and Transnistrian leaderships. <\/p>\n<p>The Ministry reminded that the Memorandum stipulated the need for working out a mechanism of the distribution of plenary powers between Chisinau and Tiraspol, and of working out a legal status for the Transnistrian region within the Republic of Moldova and a mechanism of status observance guarantees. One of the provisions for such status was that the Transnistrian region was going to receive the right to run external trade. <\/p>\n<p>After the Memorandum signature, Chisinau and Tiraspol agreed [on May 24, 1997 and on February 17, 1998] to set up bilateral working groups to create a mechanism of Memorandum realization, including the realization of that clause in the Memorandum which pertained to the region&#8217;s right of external economic activities. However, that work failed to be fulfilled then, so the Memorandum provisions concerned have remained unrealized. <\/p>\n<p>As the Ministry further held, the Russian and Ukrainian Presidents wrote in their Statement that Memorandum provisions may not be in contravention of the universally accepted norms of the international law, and may not be interpreted or used contrary to existing international treaties, OSCE decisions, or the Joint Statement by the Presidents of Russia, Ukraine and Moldova of January 19, 1996 recognizing the sovereignty and territorial integrity of the Republic of Moldova. <\/p>\n<p>However, the official Tiraspol interprets the Memorandum as the equipping of Transnistria with an unlimited right to run its foreign trade independently.
